Right to alimony

Family law states that disabled parents have the right to financial assistance in the form of alimony from their child/children. In this case, incapacity for work is confirmed either by the presence of a disability or by reaching the age of a pensioner.

Due to the increase in the retirement age in the country, the Government decided to leave at the “old” level the age when the right to receive alimony from a child arises. That is, these are 55 and 60 years.

This project has already been submitted to the State Duma for consideration. If approved, pre-retirees will be able to receive child support, even if they do not receive pension benefits due to old age.

New age and conditions of retirement for certain categories of citizens

The reform concerns not only pension insurance. The procedure for assigning maintenance due to length of service has changed.

Pension reform for the military

The new requirements did not affect military pensions. This issue is under discussion. It is planned to adjust the length of service, in the presence of which a citizen has the right to apply for pension compensation. To leave the army you will need to serve 25 years. Pension reform for civil servants

The procedure for assigning pension benefits to civil servants is determined by Law No. 166-FZ of December 15, 2001. The age for leaving public service due to old age was raised for them in 2021. Changes are being introduced gradually. Each year, six months are added to the length of service.

By 2026, you will need to have worked in the civil service for 20 years to apply for the payment. Those applying for benefits in 2021 must have 16.5 years of service.

Law No. 350-FZ introduced clarifications regarding the maximum period for holding civil service. By 2023, men will have the right to leave the civil service at old age at 65, women at 63. These activities will take place gradually. From 2021, one year will be added every 12 months.

Pension reform for teachers

According to the pension reform, teaching staff are allowed to become pensioners with a deferment of 5 years after 25 years of preferential service have been developed. Right to keep your job

According to the new law, employers do not have the right to fire their employee or not hire him because the person has reached pre-retirement age. Such an offense is punishable under the Criminal Code of the Russian Federation.

The required changes are already being made to the Criminal Code of the Russian Federation. The guilty employer may lose 200 thousand rubles (fine) or be punished in the form of compulsory work (360 hours). This legislative draft has already been adopted by the State Duma in the 3rd reading.

In addition, the timing of payment of benefits due to unemployment for pre-retirees will also increase (depending on length of service). So, if a citizen worked for 20-25 years, then the benefit will be paid for exactly a year. And for each year of work experience beyond the established duration, the payment period is extended by 14 days (but not more than 2 years in total for 3 years of payments).

What changes besides age does pension reform imply?

In addition to changing the age limit for retirement, it is planned to change the system for forming pension savings.

Accumulation system

The funded portion of the pension benefit remains frozen in 2021. This situation is expected to last until 2021. Currently, employers transfer 22% of wages to the pension fund. All funds go to the insurance portion of the old-age benefit.

Individual pension capital (IPC)

Starting in 2021, the Ministry of Finance and the Central Bank are developing a new law to replace the funded part of the pension benefit with individual pension capital. It will be formed from the personal funds of citizens. The citizen will have to sign an agreement with the NPF. It is planned to introduce a rate from 0 to 6%, which will increase by one point annually. Workers will be included in the new system automatically.

Rules for payment of the funded part of the pension

Citizens will receive the funded part of old-age benefits earlier than the general period. A one-time compensation is transferred to women who have turned 55 years old, and to men who have reached 60 years of age.

Pension points

The amount of pension compensation is calculated taking into account the IPC (pension point), which appeared in 2015. The higher the IPC value, the greater the amount of the pension benefit. The required number of points increases annually. By 2025, to apply for benefits you will need to collect 30 IPC. In 2021, compensation is assigned if you have at least 16.2 points.

The new pension size - what it will consist of

The insurance pension is calculated using the formula introduced in 2014:

SP = IPC x SPK + FV, where

IPC – pension coefficient (in 2021 16.2); SPK – cost of IPK (RUB 87.24 from January 1, 2021); FV – fixed payment (RUB 5,334.19 for 2021).

Must have accumulated at least 10 years of experience.

SP = 16.2 x 87.24 + 5,334.19 rubles. = 6,747.48 rub.

The payment amount for non-working pensioners cannot be lower than the subsistence level in the subject of residence. If the resulting value is less than the PMP, then the pensioner is given a social supplement.

In what year will the pension reform come into force?

The new requirements began to apply on January 1, 2021. The first changes affected women born in 1964, and men in 1959. For them, the time for retirement was postponed by 12 months. However, they have the right to stop working 6 months earlier.

Pensioners born between January and June have the right to submit an application to the Pension Fund from July to December 2021. Persons born between July and December will be able to apply for payment from January to June 2021.

The transition period will end in 2028.

The latest pension reform project - where to watch

The Ministry of Finance promised to publish a bill on individual pension capital by the end of 2021. However, to date it has not appeared on the Internet, as it requires further development.

What will happen to pensions in 2021?

will occur in 2021 :

  1. In terms of changing the conditions of old-age pension:
      the generally established retirement age will increase for men and women by six months (6 months) - to 60.5 and 55.5 years, respectively;

  5. Indexation will be carried out annually from January 1 .

Attention

The amount of the increase in rubles for each pensioner will be individual . To get the actual amount of your pension in 2019, you need to multiply the size of your insurance part of the pension by a factor of 1.0705 (which corresponds to an increase of 7.05%).

Such an increase will affect only non-working pensioners receiving an insurance pension for old age, disability or loss of a breadwinner. Since pensions in Russia are paid for the current month, pensioners will receive new amounts in January - indexation will be carried out from the beginning of the year.
