Rules for obtaining pensions for working disabled people of group 3 in 2021

According to the law, having a disability group of 3 is not an obstacle to work (with some reservations) and subsequent receipt of a pension for work activity. But first, you need to secure your special status by passing an examination.

Before this, however, you need to get a referral from a doctor and follow a certain sequence of steps. During a medical examination, specialists will assess the degree of limitations, health status and more.

As a result, they may be assigned group 3, in which it is not prohibited to perform work duties in the same or another place. Working disabled people apply for a pension according to the prescribed rules, which we will consider below.

General concepts

The group in question is assigned to individuals who are able to take care of themselves and perform normal activities. From the outside, they are often no different from healthy people. Group 3 disabled people in most cases remain able to work. They can switch to jobs with flexible hours or less labor intensity. Retraining is not excluded.

And yet, due to violations, as well as some limitations in opportunities, they are considered beneficiaries. For example, the state, in the form of material support, accrues a pension payment to holders of group 3, which is divided into:

state

- paid from the state budget and available to WWII participants, military personnel, citizens with the insignia of the Siege of Leningrad, victims of radiation and man-made disasters;

insurance

or labor (until January 2015) - consists of deductions received by the insurance and Pension Fund for the entire period of work, if the disabled person has work experience;

social

- accrued to all disabled people without taking into account length of service and for category 3 it is usually equal to the minimum wage or increased if a citizen with disabilities has dependents.

By the way, about disability. This concept is used if a person’s condition limits his activities in various aspects. At the same time, specialists can identify deviations in the mental, sensory, mental, and physical planes. Often, due to health problems, loss of ability to work is recorded.

The more serious the problem, the lower the assigned category. In this case, group 3 means a mild degree of restrictions, while group 1 is considered the most difficult. However, for any group, the state provides pensions and preferences to beneficiaries.

Taking into account indexation (4.3%) from February 1, 2021, the social pension of a third group disabled person is 4,592 rubles. (in the absence of dependents), and the EDV, also indexed 1.043 times, amounted to 2162.67 rubles.

The legislative framework

The process of recognizing a person as disabled and assigning a group to him is carried out during a medical and social examination (MSE) in special bureaus. This procedure is prescribed by Law No. 181-FZ “On Social Protection of Disabled Persons in the Russian Federation” dated November 24, 1995. In addition, Order No. 95 of the Government of the Russian Federation defines the purpose of the group.

Order No. 17 of the Ministry of Labor of the Russian Federation regulates medical control, issuance of a certificate, approval of a disability category and other important components of the process. Orders No. 1 of the Ministry of Labor of the Russian Federation and No. 317 of the Ministry of Health are also quite informative in this regard.

How will the assignment of disability pensions change?

In addition, the Pension Fund will be required to inform insured persons about the expected amount of the old-age insurance pension once every three years through the State Services portal.
Information will be provided to insured persons who have reached the age of 45 years and 40 years (for men and women, respectively) and who are not recipients of an old-age insurance pension. For pensioners who receive a 25% increased fixed payment to their insurance pension due to the fact that they have worked in agriculture for at least 30 calendar years, this increase to the fixed payment will be maintained when they move to a new place of residence outside of rural areas.

Only 2 months are given to collect documents, since some certificates have a statute of limitations. If for some reason a person is not able to collect documents himself, a power of attorney is drawn up for any of the family members, close relatives or friends, which gives them the right to receive all the necessary extracts.

  1. The first group - the military has completely lost the ability to work and requires constant care.
  2. The second group - there is no ability to work, but the person is able to partially satisfy his needs on his own.
  3. The third group is a person who is partially incapacitated, which can be restored in the future.
  • Failure to timely undergo an annual medical examination to determine the fact of disability - the last payment is accrued on the date indicated in the disability certificate.
  • Changing the disability group and assigning a new category - payments stop until the military man receives a new certificate, which must be submitted to the pension fund.

To apply for a pension for a war disabled person, you need to collect a package of documents and contact the relevant authorities that regulate this issue. After this, the victim will receive payments in any way convenient for him, the amount of which depends on the length of service, rank and degree of disability.

  1. A photocopy of the passport, which confirms the person’s identity, his age and Russian citizenship.
  2. An extract from the disability certificate issued by the military medical commission (a sample is given below).
  3. A document confirming the presence of disability, as well as the degree of disability.
  4. An application from the victim requesting a pension due to acquiring the status of a disabled person.
  5. Insurance certificate.
  6. Military ID and any other documents that confirm the place of work, length of service and position of a military man.

  • documents confirming the fact and date of death (death) of a citizen, recognition of a citizen as missing or declaring him dead (death certificate, court decision, certificate of the established form about the death of a serviceman);
  • documents confirming the authority of the representative (decisions, conclusions and permits issued by the guardianship and trusteeship authorities in accordance with the legislation of the Russian Federation on guardianship and trusteeship);
  • documents confirming the place of stay (actual residence) on the territory of the Russian Federation (certificate of registration at the place of stay on the territory of the Russian Federation, issued by a territorial body of the federal executive body authorized to exercise control and supervision functions in the field of migration, a personal statement of a citizen about the place actual residence on the territory of the Russian Federation).
  • disabled people (I, II and III groups);
  • disabled children;
  • veterans and family members of deceased veterans;
  • former minor prisoners of concentration camps, ghettos, and other places of forced detention created by the Nazis and their allies during the Second World War;
  • victims of radiation exposure.

The exceptions are heroes of the Soviet Union, heroes of the Russian Federation and full holders of the Order of Glory, heroes of Socialist Labor, heroes of Labor of the Russian Federation and full holders of the Order of Labor Glory. They begin to be paid EDV on January 1 of the year following the year in which they apply for EDV. Payments also cease from January 1 of the year following the year in which the application for refusal of the EDV was submitted.

The monthly cash payment is established from the day you apply for it (but not earlier than you become eligible to receive it). Moreover, if you applied for a monthly cash payment later than you became a beneficiary, you will be paid EDV for the past time, but not more than for 3 years preceding your application.

What is the pension provided for a working disabled person of group 3?

The amount of the pension and the conditions for receiving it differ depending on the severity of the injury, illness, degree of restrictions, etc. To approve the amount of payments, the total work experience of a person with disabilities is taken into account, and the period for establishing group 3 does not play a role (that is, the citizen became disabled after completing his or her activity or during it).

Let us note one more point: before calculating a disability pension, the age of the person applying and his insurance experience (at least the minimum), which is associated with age, are taken into account. Approximately, this length of service increases by 1 year for every few years of age of a citizen with a disability.

In any case, the employer pays contributions for a disabled employee in the form of taxes and fees, which significantly affect the pension. At the same time, the due pension payments are indexed (recalculated) every year without a declaration.

The insurance pension benefit of a disabled person consists of the sum of two parts: the insurance pension itself and a fixed payment to it. According to Article 15 of Law No. 400-FZ dated December 28, 2013, the insurance pension part is calculated using the formula:

  • SP - the amount of the insurance pension;
  • IPC - individual pension coefficient;
  • SIPC is the cost of one coefficient as of the day the benefit was assigned.

The value of the SIPC is established by law and is indexed annually. In 2021, the cost of the pension coefficient is indexed by 6.6%, after which it will reach 98 rubles.

The size of the IPC of a disabled person depends on:

  • the amount of insurance contributions paid by the employer for him to the pension fund;
  • the amount of insurance experience, taking into account the periods included in it.

Fixed payment to the disability insurance pension of group 3

Simultaneously with the assignment of an insurance pension to disabled people, a fixed payment to it is established. Its size is determined by law and is subject to annual indexation. Depending on the disability group, the presence of dependents and other factors, this amount is adjusted.

  • for disabled people of group 3 it is 50% of the base amount (5686.25) and was equal to 2843.13 rubles.

Persons who worked in the Far North or equivalent areas, provided that their insurance experience was at least 25 years (men) and 20 years (women), are provided with an increase in the amount of the fixed payment:

  • by 50% if the recipient has worked in the Far North for at least 15 calendar years;
  • by 30% if he worked for at least 20 years (calendar) in areas close to the conditions of the Far North;

For pensioners living in the Northern conditions, for the entire period of their residence there, the fixed payment increases by the regional coefficient applied for this territory. True, for persons who, at the same time as this right, also have the right to a pension increase for work in these areas, one increase of their choice is applied.

Additional payment to the insurance pension for disabled people of group 3 for having dependents

Among other things, the amount of the pension is adjusted according to the number of persons dependent on the recipient: if there are none, 3,022 rubles are credited, if there is one, 5,037.07 rubles are paid. If you have two dependents, you are entitled to 7,051 rubles, and if you have three dependents, you are entitled to 9,066 rubles. Thus, in addition to length of service in 2021, current marital status is also considered.

The average size of 3GI payments is 8,500 rubles. The amount of payments cannot be lower than the subsistence level (living wage).

If there is an insurance period, a disabled person receives a pension based on insurance contributions and salary level. The average size of this part is 2300 rubles.

  1. State (basic) - equal to 5,400 rubles.
  2. Social

The amount of social payments for 3GI is 4,300 rubles. The specified amount is calculated if a citizen over 18 years of age does not have the minimum length of service.

What documents may be needed when applying for a pension?

An applicant for pension payments cannot do without:

- Russian Federation passports;

— certificates of disability indicating the group;

— work book or other document confirming work experience.

As additional applications that may be required, a group 3 disabled person should prepare:

— a document about dependents (their absence or presence);

— an extract from the last place of work about the amount of salary for the past 2 months;

- certificate of departure and temporary residence abroad, if this is the case;

- certificate of change of full name (partially or completely), if this action was performed;

- a paper on obtaining a special status (disability) as a result of a radiation or man-made disaster (for those faced with such an experience).

A more detailed list of additional documents can be found in the Pension Fund, taking into account the specific situation. But it is important to understand that the right to a state pension comes into force when a citizen passes the ITU and receives group 3 with appropriate confirmation of this fact in the form of a certificate, certificate, etc.

Registration procedure

To receive payments, a disabled citizen must:

Get a full examination

The first action of a potential disabled person is to visit a clinic, namely, make an appointment with a local therapist. The doctor is obliged to issue a bypass sheet, on the basis of which the citizen goes through all the necessary doctors and takes tests.

After this, the patient returns to the doctor and submits the results of the examination. Within two weeks, the therapist studies the received documents and then prepares a referral for further commission examination.

Receive the official title of disabled person

Group assignment is carried out at the ITU office.

  • passport;
  • statement;

  • characteristics from work.

The bureau carries out the following actions:

  • Setting up a group.
  • Checking documentation.

  • Determining the duration of disability.
  • Studying the psychological data of a citizen.
  • Consideration of social and housing conditions.
  • General assessment of the applicant's condition.

After ITU completes these actions, bureau employees draw up an act recognizing (or not recognizing) the citizen as disabled.

Prepare documentation

After assigning a third or another group, the citizen is obliged to prepare documents for the Pension Fund, which include:

  • passport details;
  • ITU act;
  • employment history;
  • application - sample can be downloaded from the link;
  • certificate of average salary;
  • SNILS;
  • documents on change of name;
  • certificate of residence;
  • documentation of dependents.

Contact the Pension Fund

The disabled person submits the entire package of documentation to the territorial branch of the Pension Fund. If a citizen cannot personally contact the Fund, then an official authorized representative has the right to hand over the documents.

The period for reviewing documents is 30 days. The time allowed for making corrections is 3 months from the date of filing the application.

There are the following ways to receive payments:

  1. Mail – with personal delivery or.
  2. Bank card.
  3. Confidant.
  4. Organizations involved in the delivery of pension contributions - a complete list is available on the website https://www.pfrf.ru/.

After the expiration of the ITU act, the disabled person undergoes re-examination to extend payments.

Amount of increase in minimum compensation

Now let’s consider such an issue as the supplement to the pension accruals of a working disabled person of group 3. Alas, for persons in this category, unlike holders of groups 2 and 1, no allowances are provided in 2021. Group 3 disability allows you to choose one of the options, namely: labor pension and EDV or social pension and EDV.

The EDV is added as a supplement to the basic pension, depending on the set of social benefits used (left in kind). Social services mean:

— free travel on public transport;

— vouchers to the sanatorium issued every year free of charge;

— prescription medications (they can be obtained at a discount of up to 50% or at the expense of the state).

You can refuse the listed preferences in full or in part by choosing their cash equivalent. By the way, the EDV will be indexed on February 1, 2021 and, together with the NSU for disabled people of group 3, will amount to 2,336.70 rubles. As for the social package, it is equal to 1,211.66 rubles, where 933.25 rubles are for medicines, and 134.04 rubles are for travel in transport and, finally, 144.37 rubles are for vouchers.

The size of the pension for disabled people of the 1st group in 2021

  1. EDV (monthly cash payments) is the realization of a person’s rights to benefits, expressed in monetary terms. This amount does not depend on the region where the person entitled to such payments lives. EDV are fixed throughout Russia and are subject to indexation annually from February 1. Different groups of beneficiaries in 2021 receive differentiated amounts: from 2,638.27 rubles for combat veterans to 5,754.82 for Chernobyl survivors.
  2. DEMO (additional monthly financial support). There are two types of such payment - 500 and 1,000 rubles, and it is paid according to the first amount on a general basis. Those disabled people who were injured during the Second World War (although there are only a few of them left) or during their stay in concentration camps, or due to hostilities can count on 1,000 rubles of security for this type of monetization. The remaining categories - WWII veterans and their widows, as well as other categories of people who survived through all the hardships of those years to this day - receive 500 rubles a month.   3. NSU (Set of Social Services). To receive this benefit, a disabled person does not need to worry, since it is stationary and all the arrangements for it are carried out by the relevant government bodies. A disabled person of the 1st group can receive in monetary terms, according to the application he wrote, 930.12 rubles every month. This amount includes the provision of medicines, part of the cost of a trip for 2 people to health institutions, as well as travel to places of treatment and recovery. During the year, for the total amount you can visit any specialized sanatorium.
  4. FSD (federal social subsidies). This type of assistance is for those who receive an amount that is lower than the cost of living, which is now 4,700 rubles. This benefit includes not only money, but also compensation for the disabled person’s expenses for telephone, travel and utilities.
