General concepts

Disability as a status and a specific group are established after passing the MSE (Medical and Social Examination). Only on the basis of a disability certificate does a person become a recipient of a pension and benefits. In any case, it is useful to have an understanding of concepts such as:

— EDV is an additional payment accrued to persons with disabilities as an alternative to benefits in kind;

- benefits - preferences that the state provides to socially vulnerable categories;

- disabled people - citizens with health problems and limitations of a certain severity who need social protection and rehabilitation;

— Disability group 1 — a category that means loss of independence and ability to work, as well as the need to receive assistance from third parties.

What does the set of social services include?

The set of social services includes three components: medical, health resort and transport. Accordingly, this is:

• Free medicines and medical products that can be obtained with a doctor’s prescription, as well as special food for a disabled child.
• Vouchers to a sanatorium for the treatment and prevention of diseases.
• The right to free travel on commuter trains and intercity transport to the place of treatment and back (for disabled people of the first group - with an accompanying person, who also travels for free).

Formally, this is a very good set of benefits, but in fact, it is possible to get free medicines, and even more so a trip to a sanatorium, in very rare cases.

If you succeed in using the right to a benefit, then to receive the benefit you need to provide the following documents to the medical institution or the railway ticket office:

• passport,
• a document confirming the right to benefits,
• certificate from the Pension Fund.

If it is unrealistic to receive a benefit, the state allows beneficiaries to replace these social services with real money and receive monthly monetary compensation. This is the money that is allocated as funding for benefits. If in practice it is not possible to obtain benefits, people with disabilities and representatives of other categories can at least receive money and at least buy those medicines that are urgently needed and which cannot be obtained for free.

Conditions for establishing group 1

Those who can confirm their disability with medical reports and certificates, as well as provide the Pension Fund of Russia with a full package of required documents and present them before October 1, have the right to accrue EDV.

As for group 1 itself, it can be given to the subject in the following cases:

- establishment of disorientation in space;

— a person’s inability to care for himself when assistance with care, provision, etc. is required;

— fixation of motor function disorders, causing difficulties with movement or even the impossibility of this process.

This group is established during the ITU for several years, after which it is again necessary to undergo examination and confirm the status. In particularly difficult cases, the group is given for an indefinite period, which eliminates the need for another health assessment.

! Disabled minors with incurable diseases, injuries and defects are classified as “disabled children of group 1”.

How is EDV assigned for disability in 2021?

A monthly cash payment is assigned from the date of application for it for the period during which the citizen belongs to the category of persons entitled to the monthly allowance, but not before the right to the specified payment arises.

The day of application for the appointment of an EDV is considered to be the day the territorial body of the Pension Fund of the Russian Federation receives the application with all the necessary documents.

To accrue EDV, the territorial body of the Pension Fund of the Russian Federation opens a personal account for each recipient of this payment.

A pensioner registered with the territorial body of the Pension Fund does not need to open an additional personal account; the accrual is made in the appropriate section of the personal account of this pensioner.

Legal basis

From a legal point of view, the rights of persons with disabilities are regulated by the following regulations:

— Law “On Social Protection of Disabled Persons” No. 181 Federal Law;

— Presidential Decree No. 1474 “On measures to create an accessible living environment for people with disabilities”;

— Federal Law No. 122, which considers the monetization of benefits for persons with group 1 and not only;

— Decree of the Government of the Russian Federation No. 1449 “On measures to ensure unimpeded access for people with disabilities to information and social infrastructure facilities.”

Rules for issuing EDV

To receive the payment, the applicant must:

— undergo a medical examination and document the presence of group 1;

— submit a corresponding application to the Pension Fund department;

— prepare and provide a list of required documents;

— register an account and report it so that EDV is transferred there.

For a minor beneficiary, his legal representative handles the registration, and from the age of 18, a group 1 disabled person can independently apply to the Pension Fund.

Composition of the NSO for disabled people of the 3rd group as of 2018

First of all, the NSO compensates for the cost of medicines and goods. The kit allows you to receive free medications if you have a doctor's prescription for a specific medication. The next thing that the NSO can provide is the opportunity to receive a free referral for recreation or treatment in a sanatorium or resort. This opportunity is provided to disabled people once every two years. The next component is the right to completely free travel on railway transport. To get a free ticket, you need to go to the box office with a certificate from the recipient of a set of social services.

NSOs in 2021 have a set monetary indicator:

1. Compensation for medications – 808 rubles/month.
2. Vouchers to a sanatorium or resort with benefits – 125 rubles/month.
3. Reimbursement for railway travel – 116 rubles/month.

List of services in return for which you can receive EDV

According to Federal Law 3 122, the payment in question is a fixed amount that is paid in addition to the pension. But this happens after the disabled person refuses the social package. services. It is worth knowing that the social package for disabled people of group 1 consists of:

— free travel in public transport except taxis and minibuses;

— travel to and from the place of treatment, paid for from budget funds (preference is valid for a person with disabilities and his accompanying person);

— medications issued according to a doctor’s prescription (also provided free of charge);

— vouchers to the sanatorium for the state. invoice (including for an accompanying person);

— medical equipment and dressings (if you have a prescription, everything is free);

— dentures paid for by the state;

— free orthopedic shoes;

- simple prosthetics for arms or legs.

In addition, among the advantages for group 1 are admission to an educational institution without competition and the right to an increased scholarship. Plus, disabled people in this category must work no more than 35 hours a week. But you will be able to refuse in favor of EDV only a trip to a sanatorium, medicines and trips around the city (it is possible to exclude the entire social package, or only part of the services).

What amount of EDV is due to disabled people of groups 1, 2, 3 in 2021

Since the volume of the social package for each group of beneficiaries is somewhat different from each other, the size of the monthly allowance for these categories is correspondingly different. In addition, the monthly allowance for disabled people, as well as the basic pension, is annually subject to indexation in accordance with the growth of inflation. So, in 2021 it was indexed by 5.4%. In monetary terms, this year disabled people received a fixed monthly allowance for the first group - 3,542 rubles, for the second group - 2,530 rubles and for the third group - 2,025 rubles.

What amount of EDV is due to these categories of citizens in 2021 will depend on the overall percentage of indexation, which is carried out every year in early April. Presumably, this coefficient could be more than 5%, like the entire inflation rate in the country.

In addition, today the EDV may differ depending on the region in which the beneficiary lives, since the size of social packages is now formed at the regional level. For example, residents of the extreme northern regions, due to unfavorable weather conditions, always have a higher level of benefits than residents of the south. Residents of the capital also represent a separate category. Since living in Moscow involves significantly higher expenses, the beneficiary receives more compensation.

What else can be added is that no matter what group the beneficiary has, he can receive a pension only on one basis: either according to the disability group, or as a social pension, or as a pension based on the earned insurance period. But which of the grounds for EDV to choose is a group 1, 2, or 3 disabled person who decides for himself.

Size and composition of the NSO

EDV recipients may be provided with social services. At the same time, the size of the EDV is reduced by their cost (Part 3 of Article 6.3 of the Law of July 17, 1999 N 178-FZ). The cost of a set of social services is also changing from February 1, 2021.

The total amount of the EDV includes the cost of the entire set of social services ( NSS ). In it, each federal benefit has its own price. Accordingly, the set of services itself is subject to indexation by two and a half percent from February 2021, which consists of: - provision of medicines: 828.14 rubles; — sanatorium-resort treatment: — 128.11 rubles; — travel: 118.94 rubles.

The beneficiary can receive any of these services in “kind” form or in cash. Thus, the indexed amount of NSS will be in 2021: 1075.19 rubles.

In case of complete refusal of the NSO, the monthly cash payment will be set in the amount indicated in the table. In case of partial refusal, the cost of the service is deducted from the established amount.

For a disabled person of group 3, starting from February 2021, in the event of a complete refusal of the federal set of services, the monthly allowance will be set at 2073.51 rubles.

For a combat veteran receiving only preferential drug coverage, the monthly cash payment will be 2022.12 rubles.

The calculation of the EDV in this case for UBD is as follows: the cost of medicines (828.14 rubles) is subtracted from the total cost of the package due 2850.26 rubles. Now, along with the monthly amount of 2073.51, he will be able to receive preferential provision of medicines.

Documents for calculating EDV

It is possible to use the described type of assistance after collecting documentation. In particular, the Pension Fund is asked to:

— passport confirming identity, indicating registration, etc.;

— a certificate of disability as proof of the right to receive EDV;

— application for payment;

- other papers (for example, if a disabled person is under 14 years old and a guardian acts for him, you will need to confirm the fact of guardianship or bring a certified power of attorney if his representative carries out the process for a disabled person).

Let us pay special attention to the application, because the success of completing the EDV largely depends on the correctness of its completion. So, in the form the applicant indicates initials, residential address, and passport details. Plus, it is important to outline the grounds on which the amount of the payment will be determined. In addition, the disabled person undertakes to report changes regarding payments (for example, he changed his place of residence, his group was removed, etc.). At the end, the date of writing the application and the signatures of the parties are indicated.

The presented general list of the package of documents differs in each specific case, so before registration it would not hurt to clarify the full list with the Pension Fund.

Conditions for issuing EDV in 2021

People with disabilities are given a choice: to receive EDV in 2021 in cash or in the form of in-kind assistance. A disabled person can exercise the right to receive EDV immediately after assigning a group.

To receive payment, you must submit an application along with copies of documents:

• passport of the citizen applying for payment, birth certificate of the child who received disability, if he is under 14 years old, and compensation is issued to him;
• an extract that confirms the disability group of the applicant;
• passport and power of attorney to transfer documents to the representative if the disabled person is unable to attend a personal reception at the pension fund.
