Early retirement based on length of service under the new law

From January 1, 2021, a new basis for early retirement in old age is in force in Russia - having a long work history . According to the new law, in order to receive an early pension, you will need 42 years of service for men and 37 years for women. If a citizen has worked for this number of years, he will have the right to become a pensioner 2 years earlier than retirement age.

Russian President Vladimir Putin announced some legislative decrees regulating early retirement in 2019. The State Duma published changes with restrained conditions applicable to retirement. These changes have been in effect since October 3, 2018 and affected Federal Law No. 350.

  • Women's planned retirement at 63 has been reduced to 60.
  • The conditions and provisions for early retirement have been relaxed for those who planned this exit in 2019-2021. Thus, previously it was possible to obtain a pensioner’s certificate no earlier than 2020, but now this can be done six months earlier.
  • Unemployment benefits increased to 11,200 rubles. for those who do not have enough work experience - payments at 68 years for women and 70 for men.
  • The age for pre-retirement workers is from 55 years for women and from 60 years for men (previously this was the threshold for reaching retirement age); during this period, working citizens have the right to use social protection against dismissal.
  • The retirement period for early workers has been reduced from 8 to 5 years.

To ensure that a laid-off person is not left without money, he needs to register with the federal employment bureau - this will allow him to receive unemployment benefits for some time. For the rural population, the authorities will provide a quarter increase for pensioners who have not found work, but have previously worked for 30 years in the agricultural industries.

However, this mitigating reform will not affect other categories of people:

  • hazardous workers,
  • disabled people and citizens whose parents are disabled,
  • single mothers,
  • military personnel who served in “hot spots” (veterans of the Afghan, Chechen, Ossetian and Donbass wars) and conscripts.

Only mothers with many children will be able to retire early in 2021: each child is a factor in reducing the retirement age limit. For example, a mother of three children can receive additional benefits at 57, a mother of four – at 56. But a mother who has raised five or more children is entitled to benefits already at 50 years old.

Experience for early retirement in Russia under the new law

Starting from 2021, citizens with a long work history will be granted the right to early retirement. This change in pension legislation was provided for as part of the new pension reform of 2021 and is enshrined in Part 1.2 of Art. 8 of Law No. 400-FZ of December 28, 2013. To become an old-age pensioner early, you need to have at least 37 years of insurance experience for women and 42 for men .

According to the new law, the right to early retirement based on length of service is granted with a number of restrictions:

  • The new benefit does not imply that after working for a set number of years (37 or 42), a person will be able to immediately retire into old age pension. For citizens who have worked for such a long period of time, the retirement age will only be reduced by 24 months relative to generally established values.
  • The retirement age, determined taking into account such a benefit, cannot be lower than 55 years for women and 60 for men (that is, lower than the values ​​under the old legislation). It is for this reason that in the first years of the reform, not all citizens will be able to fully take advantage of this preferential condition.
  • In addition, the calculation of the length of service giving the right to receive a pension on preferential terms differs from the calculation of the insurance period. Not all periods will be included in it , for example, military service, maternity leave, and so on will be excluded.

Early retirement

For a long time, a certain age was established in Russia when citizens who worked during their lifetime had the right to retire. Before the start of the corresponding reform, it was 55 years old (female) and 60 years old (male).

At the same time, certain categories of workers had the right to end their working career before the generally established age. In particular, this concerned workers who were employed in industries with difficult and hazardous working conditions, doctors, teachers and some other employed citizens.

After the start of the above-mentioned reform, which involves a significant increase in the age when citizens will be able to apply to the pension fund for the assignment of financial support, the right to early retirement for beneficiaries remains, but with some changes.

In addition, the list of these beneficiaries has expanded; now workers who have an impressive amount of work experience can also apply for early retirement benefits. In this case, the sphere of employment of these persons and whether they have financial benefits does not matter.

Also noteworthy is the deadline for early exit. Thus, men who have worked for a long time have the right to retire 2 years earlier than their peers who do not have the right to do so.

However, with all this, not all citizens will be able to take advantage of the benefit in its entirety. Thus, the pension reform currently being carried out in Russia does not imply the immediate achievement of its goals, but a certain transition period when the age will increase smoothly. It is 5 years for both men and women.

Accordingly, after the end of the pension reform, male beneficiaries will be able to retire 24 months earlier - at 63 years old.

Calculating benefits during the transition period is somewhat more complicated. Thus, it has been established that, taking into account the preference under consideration, the lower limit of the retirement age for a man cannot be less than 60 years.

In this regard, in 2021, citizens who have worked for a long time have the right to go on vacation only six months earlier. In 2021 it’s already one and a half. And starting from 2022, citizens will be able to take advantage of the preference in full, namely, start receiving material funds for pensions 2 years earlier.

Early exit based on length of service

The procedure for early retirement itself has been changing since 2019. As a result, changes in pension laws increase the working age level of citizens, and the physical age of a person in general. But the increase in working age will not happen immediately, but gradually, as citizens pass through the machine of this reform.

At the same time, the list of specialties for which a person has chosen a job and profession will not change in relation to “early-term” pensioners - it still includes:

  • Doctors,
  • teachers,
  • Military personnel,
  • Workers in hazardous professions that shorten life expectancy
  • Sailors (these are dockers, sailors, fishermen, etc.),
  • Russian Railways workers,
  • Drivers (including OT drivers and truckers),
  • Lumberjacks.
  • This list was revised and approved only during the collapse of the USSR. Workers in all these professions count on early retirement if a number of requirements are met:

    The age of such a citizen fits within the rules for professions from the 1st or 2nd list;

    The length of service in these positions (general and highly specialized) has reached the minimum required levels.

    Marks for list 1:

    • General and specialized experience for 45-year-old women: 15 and 7.5 years of work, respectively;
    • For 50-year-old men it’s the same – 20 and 10 years.

    Marks for list 2:

    • 50-year-old women must have a total experience of at least 20 years and a specialized experience of at least 10.
    • For 55-year-old men, these are 25 and 12.5 years, respectively.

    If the general period is not enough, such an employee receives compensation at the expense of a longer, highly specialized one.

    Conditions for doctors and teachers

    “Pre-term workers” from among doctors and teachers in 2021 were also subject to the changes of this reform. Early retirement for teachers and doctors, starting in 2021, will simply be postponed. Compensation will now be paid only 5 years after gaining the required length of service. Previously, such a deferment lasted for 8 years, but the president reduced this period. After these 5 years, the doctor who provided the relevant documents must first work for at least 30 years (in rural areas this mark is equal to a quarter of a century). For teachers, this indicator is the same for rural and urban areas and is only 25 years. However, even if it is legally proven that a given citizen has the right to receive payments, they will not be accrued immediately. The bureaucracy carried out will not entail any measures or restrictions on the continued work of a given citizen.

    In general, the change carried out by Putin will allow a doctor or teacher who has worked the required period by 2021 to receive an early pension six months later - in 2019-2020, but the payments themselves will be issued only in 2021-2022. Subsequently, when the work experience of already working teachers and doctors reaches 25 or 30 years - in future years - the period for receiving early pensions and the calculation of payments will accordingly shift by more than two years from the moment citizens from these categories apply. And only after another 5 years from the time of accrual, these citizens will receive the payments due to them.

    Early exit for residents of the Far North

    People living and working in the regions of the Far North (for example, the Yamalo-Nenets Autonomous Okrug) reach retirement benefits earlier than the rest of their fellow citizens. According to changes in pension legislation, the age mark of 50 years for women and 55 years for men is increased by 5 years. The changes will affect all pre-retirees who subsequently become pensioners until 2023. The next generations of able-bodied citizens who subsequently replaced them will be considered pensioners only after reaching the age of 55 and 60 years, respectively - as previously happened with all Russians going on a “well-deserved rest.”

    Early retirement with 37 and 42 years of service (table)

    Having completed 37 years of service for women and 42 years for men gives them the right to reduce the retirement age by 24 months . According to the new law, the retirement age for Russians has been increased to 65 and 60, which means that you can become a pensioner early at 63 and 58 years old (24 months earlier).

    During the transition period (2019-2023), when the retirement age will gradually change, the retirement age will be different. It will be determined in relation to intermediate standards according to the table below:

    The table shows that in the first two years of the new law, the age reduction does not occur fully (by less than 2 years). This is due to the restriction that the retirement age can be reduced to no more than 55 years for women and 60 for men .

    Therefore, in 2021, if you have a long work history, you can retire early at 55 and 60 (only six months ahead of schedule ). In 2021, it will be possible to become a pensioner 18 months earlier - at the same 55 and 60 years. Starting in 2021, the age will decrease by 24 months.

    How is length of service considered to give the right to early retirement?

    When calculating length of service for premature termination of work, specialists are guided by the rules prescribed in a special resolution. The length of service includes all calendar periods of work performed by the employee on a permanent basis and throughout the full working day. The calculation also includes calendar stages during which the employee was on paid sick leave for health reasons.

    If a citizen during some periods of time worked part-time or less than a full week, then only the time actually worked is taken into account. When calculating length of service, the transfer of a pregnant woman to light work is also taken into account.

    Early retirement: table by year of birth

    Due to the transitional provisions of the law on increasing the retirement age in Russia, Russians will be able to become pensioners early based on length of service at different ages. This will depend on the citizen’s date of birth and, accordingly, the retirement age established for him.     Thus, women born in 1964-1965 and men born in 1959-1960 with a long work history will not be provided with the benefit in full (the reduction will occur only by 0.5 and 1.5 years). For women born in 1966 and men born in 1961 The age reduction will be carried out in full - minus 2 years from current standards .

    After the end of the transition period of the law on raising the retirement age, the final parameters for preferential retirement based on length of service will be established.

    • Women born in 1968 and younger who have worked for 37 years will retire early when they reach 58 years of age.
    • Men born in 1963 and younger with 42 years of insurance experience will be able to become pensioners at 63 years old.

    How will early retirement be calculated in the coming years?

    From 2021, the generally established retirement age has been raised to 65 years for men and 60 years for women. At the same time, a long transition period is envisaged, which began on January 1, 2021 and will end in 2028 for men and women at the same time. In total, the transition period will last 10 years. Raising the retirement age at the first stage will affect men born in 1959. and women born in 1964

    However, for those citizens who are due to retire in 2021 - 2020, a special benefit is provided, namely: retirement six months earlier than the new retirement age. The Pension Fund of St. Petersburg and the Leningrad Region spoke about how early retirement will be calculated.

    For example: A woman turns 55 on February 15, 2021, taking into account the specified benefit, the right to a pension arises from August 15, 2021 (you can submit an application within a month starting from July 15, 2019).

    From January 1, 2021, there will also be an opportunity to retire early for citizens with extensive experience. Women with at least 37 years of experience and men with at least 42 years of experience will be able to retire two years earlier than the generally established retirement age, but in any case not earlier than reaching the age of 55 years for women and 60 years for men.

    The insurance period of such persons includes periods of work that were performed on the territory of the Russian Federation and for which insurance contributions were paid to the Pension Fund, as well as periods of receiving compulsory social insurance benefits during the period of temporary disability. Other periods (military service, parental leave, etc.) are not included in the required insurance period.

    For example: a man with a date of birth of 02/15/1959 has the right to retire at 60 years and 6 months, i.e. 08/15/2019. However, if he has 42 years of service, he will be able to retire at 60 years old - 02/15/2019.
