Who is assigned the status of a disabled child?

Disability is a long-term or continuous impairment of socialization and ability to work, provoked by acquired pathologies, illnesses from birth, and injuries.

Not all people with disabilities have the right to assign status and enjoy benefits.

Children are officially registered as disabled if:

  • there is a serious disease of the systems caused by congenital pathologies and other circumstances. They may be injuries received;
  • a serious violation of the quality of life occurs when the child is not able to personally care for himself, his movements are difficult and there is dysfunction in the social sphere;
  • great need for social protection.

IMPORTANT: When all factors are combined, children under 18 years of age are recognized as disabled or disabled since childhood. Deterioration in health that does not interfere with normal life is not recognized as grounds for obtaining status.

What does it mean to be disabled since childhood?

Government Decree No. 95 of February 20, 2006 specifies the procedure for acquiring status. Since 2014, “disabled since childhood” has been abolished, but the concept itself exists. If a citizen received status before 2014, then he remains and all the benefits are retained.

The Department of Labor cites a number of factors. If they are present, the child is called disabled since childhood:

  • people who received injuries or pathologies before the age of 18, with congenital diseases and who became disabled due to a serious illness;
  • a disabled person who developed non-progressive physical and mental disabilities.

When does a disabled child’s pension end?

Upon reaching 18 years of age, the status of “disabled child” loses its validity and pension payments cease. If the disability remains, the citizen confirms it with the ITU in the new status of “disabled since childhood”, and in this case it is imperative to come to the pension department for an appointment and assign all due payments on a different basis.

The amount of payments in this case may be revised and calculated depending on the degree of disability. The category “disabled since childhood” involves the division into 3 groups of disability as in adults, and implies the appointment of the same payments - daily allowance and pension.

How to apply for disability for a child

Establishing a disability pension for a child is the right of mother, father, people who have taken guardianship, and legal representatives.

To receive payments for a disabled child, you will need to submit an application to any department:

  1. Pension Fund of the Russian Federation - find an office based on the child’s registration or residence.
  2. Multifunctional Center.

To whom and how can you submit an application:

  • father, mother or guardian;
  • through an official authorized to do so with a notarized power of attorney;
  • online through your personal account at the MFC or PF;
  • send via mail.

IMPORTANT: when sending a document through the post office, the date of submission of the document will be the date of departure.

The most important thing is to obtain a medical certificate confirming the presence of a serious illness. The diagnosis is made by an expert doctor.   • applicant's passport;
  • papers that confirm the authority of the representative - power of attorney, permission from the guardianship authority, adoption document;
  • the child’s birth certificate or passport if he is over 14 years old;
  • an act from the ITU that established disability;
  • a document confirming Russian citizenship or indicating permanent residence in Russia;
  • insurance certificate of the child and the applicant.

What is it permissible to spend a child’s disability benefit on?

State charges are issued to parents or guardians who choose a convenient option for receiving funds:

If we talk about further expenses, then there is no need to provide reports and receipts. However, the state expects that funds will be spent on one of the following options:

There may be other goods necessary for the development of a minor citizen. However, these rules only apply to biological parents. If a disabled child is taken into care, his representatives must account for the expenditure of disability benefits so that there is no doubt that the money goes specifically to the sick child. Such a report is compiled for a year and must be submitted before February 1 of the following year. Receipts and checks must be attached to the report.

How is a child’s disability pension determined?

The set of papers submitted to government agencies will be reviewed within ten days. Then the benefits are assigned.

The pension for a disabled child in 2021 is set at 12,577.42 rubles. After the April recalculation, it became higher by 4.1%. Group 2 disabled people have the right to receive 10,480 rubles. The pension for a disabled child of group 3 is calculated at 4,454 rubles.

In addition to the basic pension, a disabled child is guaranteed a monthly financial allowance (MSA). The value is fixed in Federal Law No. 181 of November 24, 1995. This year it is equal to 2607.93 rubles.

The amount of payments consists of a set of social services. These are material resources that are intended:

  • for the purchase of medical drugs and devices;
  • costs for travel, sanatorium treatment;
  • to pay for a ticket to the camp, not only for the child, but also for the adult who will accompany.

The amount of NSS from the winter of this year is set at 1083 rubles. Accruals are made every month. If the money is spent according to the listed instructions, then it is deducted from the material benefit.

Pensions for a disabled child are calculated as follows: a fixed amount is multiplied by the indexation coefficient, which is the percentage inflation for the previous year. When children live in the North or another region where increased rates are provided, the amount of accruals will increase.

After the child turns 18, pension payments are formed depending on the disability group. The minimum and maximum amount of charges is not fixed. They are produced under equal conditions for everyone.

How to calculate the amount of child disability benefits?

For this procedure you will need a special formula: P=FV*K.

Explanation:

  1. P - pension;
  2. FV - fixed amount of payments established by the state for the current year;
  3. K is the indexing coefficient.

However, it is impossible to know in advance the percentage of future indexation. Although it is considered planned, this only applies to the event itself. Charges increase by the percentage of inflation for the previous year. This value must remain current until the next indexing or other resolution of the Government of the Russian Federation.

Are there plans to increase pensions for disabled children in 2021?

From the first days of next year, people are expecting changes in pensions for disabled children in 2021. Pension accruals will depend on several criteria. The minimum wage plays the first role in the formation of benefits. For children, payments are made in an amount equal to 60% of the minimum wage.

The system for approving benefits will be no different from last year. The scheme is the same. The amount of accruals for a separate program, which is based on targeted funding by region, will also change.

Indexation has been carried out since April. Thanks to her, an increase in accruals is expected. It is unknown what size of indexation awaits us in 2019. It is not yet clear what pension will be given to disabled children.

But it is encouraging that government officials are considering increasing pensions for disabled children, as the cost of food, basic necessities, toys, toiletries, and clothing is rising.

Pension amounts for disabled people in 2020

Due to the economic crisis in the country, rising prices for food and utilities, people with disabilities are the most poorly protected social group of the population. These people survive only on pensions. But due to economic problems in the country, payments are constantly delayed or frozen for an unknown period of time. Types of payments provided for disabled people:

  1. Social benefits that do not depend on a citizen’s work experience; their volume directly depends on the subsistence level established in the region where the person lives.
  2. Labor or insurance payment depending on the length of work experience, which is measured in pension points, and the achievement of retirement age.

Are there any additional payments to the pension of a disabled child?

Regions offer government support to families with disabled children. In the Northern capital, in addition to the basic amount, 6,223 rubles are paid every month for a disabled child and 14,021 rubles. for children with special needs.

Monetary support is transferred to the designated card. It is impossible to withdraw cash from it. You can pay in children's stores for the purchase of food, toys, and clothing.

Additional payments for families with disabled children

The legal representative who provides upbringing and care receives 5,500 rubles - a care allowance. In accordance with the Decree of the President of the Russian Federation of March 7, 2021, from July 1, the amount of compensation will increase to 10,000 . Parents caring for a disabled child of groups 3 and 2 cannot claim this amount. If a stranger is caring for a patient, he is entitled to a compensation payment of 1,200 rubles.

Financial assistance, called EDV (monthly cash payment) - 2527, is accrued along with the pension. It must be remembered that this amount includes the cost of a set of social services (NSS). Parents have the right to choose the method of receipt: services or cash equivalent. If parents wish to use the list of activities aimed at treatment and rehabilitation free of charge, then the amount of NSU is deducted from the EDV. In 2021, the cost of the set is 1211 rubles .

Help for disabled people from subjects

Some subjects of the federation provide additional financial assistance: Moscow and the Moscow region pay parents caring for sick children or disabled children 12,000 rubles monthly. St. Petersburg provides additional support to families raising special needs children. They are received by non-cash payments to a social card.

Funds cannot be cashed out; they are used to pay for various services.

How much does the mother of a disabled person earn?

It is difficult to name the specific amount of a preferential pension for mothers of disabled children, because when establishing it, several nuances are taken into account.

  • additional compensation (if the mother uses a package of social services - 1,478 rubles, 2,527 - if she refused the NSS);
  • payments that are made every month;
  • work experience;
  • care allowance;
  • benefits for utility bills;
  • salary size;
  • number of pension points.

The basic amount that is due to all pensioners is 4805.11 . To this amount is added 30% for each dependent. If a mother is raising one minor, then the state payment is 6246.65. The remaining charges from the list are added to this figure.
