How to check the blacklist of Kyrgyz migrants in Russia?

The Migration Service controls the movement of citizens from foreign countries and from the CIS across Russia and looks for illegal immigrants.
Its actions are aimed at reducing the likelihood that people who systematically violate the laws of the country, criminals, and members of terrorist groups will enter the Russian Federation.

Information about violators is blacklisted. In 2021, approximately 800,000 foreigners were included. All of them were banned from entering the Russian state.

The concept of “FMS Blacklist”

The black list is a list of persons without Russian civil status who have committed a violation of Russian legislation while on its territory. Migrants usually find out about their inclusion at the border.

It is not only the migration service that has the right to restrict entry into the state. This can be done by the Federal Security Service, the Foreign Intelligence Service, the Ministry of Foreign Affairs, and the FMBA. For the majority of foreigners, coming to the country is impossible precisely because of non-compliance with migration standards.

Five years ago, the Russian Federation strengthened control over illegal immigrants. In 2014, 200,000 foreigners were included in it, and by 2021 this figure was increased to 800,000.

In general, the media began to use the term “blacklist”. A similar list actually exists, but it has a different name - A&S CDB UIG. It contains the following information about the violators:

  • number, series of passport; Full Name; citizenship; date, month, year of birth;
  • date, month, year of arrival/departure; number, series of migration card;
  • registration address;
  • information about received patents;
  • information about issued temporary residence permits and residence permits;
  • other data.

Using this list, employees of the Ministry of Internal Affairs of the Russian Federation check whether a foreigner is legally in the state and find those who violate migration rules.

For whom Russia is closed: you can search for your name on the blacklist in advance

The Federal Migration Service (FMS) of Russia has launched a new service on its official website, allowing foreign citizens to find out about restrictions on their entry into the territory of the Russian Federation, said the head of the FMS, Konstantin Romodanovsky.

“I hope that our information resource will help foreign citizens determine their status, understand whether they can come to Russia in the coming years, and draw conclusions,” explained K. Romodanovsky.

The head of the FMS recalled that such a measure as closing the entry was not introduced today, but since the beginning of 2013. it became more effective: entry to foreigners who violated migration rules was automatically closed. The main reason for the ban on entry into the Russian Federation for three years is exceeding the period of legal stay on the territory of the Russian Federation.

To date, entry into the territory of the Russian Federation for violations of migration legislation is closed to 380 thousand people. Only for January-October 2013. The Federal Migration Service sent more than 330 thousand requests to close the entry into Russia of foreign citizens and stateless persons. At the same time, entry into the territory of the Russian Federation was prohibited for 323 thousand people.

During the same time, 53 thousand 898 foreign citizens and stateless persons were expelled and deported from Russia.

Let us remember that in mid-November 2013. State Duma deputy from the A Just Russia faction Mikhail Serdyuk proposed banning entry into the country for foreigners and stateless persons convicted of committing intentional serious crimes. They will not be allowed into Russia even if they have an expunged criminal record.

Reasons for being included in the list

The Migration Service restricts the entry into the state of foreigners who:

  • committed a violation of registration standards;
  • violated customs regulations;
  • did not comply with sanitary standards;
  • have a debt to a banking organization, the tax service, or the recipient of alimony payments;
  • provided government employees with false information;
  • were brought to administrative responsibility more than 2 times.

If any of the above circumstances exist, information about the foreigner is entered into the migration service database. After this, the migrant is subject to a ban on visiting the country (the duration of the ban is from three to ten years). How long the restriction period will be depends on the type of violation committed.

The restriction on entry into the Russian state is valid for five years if the migrant has been in the country illegally for six to nine months . If the foreigner stayed in the state longer, the period increases to ten years.

Attention! Even if you have not committed any of the above violations, remember that no one is immune from mistakes.
You may turn out to be the namesake of a foreigner who has been banned from entering Russia. To avoid getting into an unpleasant situation and wasting money, before arriving in the Russian Federation, check your own passport to see if it is on the migration service’s blacklist.

How to remove the ban

It can be canceled if the basis for its issuance is declared invalid by a decision of an official or a judicial act. You can appeal a decision on expulsion or the imposition of other administrative punishment through the application procedure.

Filling out an application addressed to the head of the GUVM department

There is no single established form of the document. The statement states:

  • date, information about the applicant;
  • information about the procedural document on the basis of which a citizen of another country was banned from entering Russia;
  • information on which the interested person bases his request, with reference to the rules of migration and procedural law, depending on the specifics of the violation.

The application must be made in two copies. One is submitted to the office of the authorized agency. Another copy must bear a mark indicating acceptance of the document for consideration.

A decision on an entry ban is not considered a separate type of punishment. It is accompanied by liability for committing a specific offense in the form of a fine and expulsion (deportation).

It makes sense to carefully monitor the deadline - usually this is no more than ten days from the date of the decision to bring to administrative responsibility. If the deadline is missed, it can be restored. Practice shows that appealing an entry ban, unless clearly gross violations of the law are obvious, is ineffective administratively. You will need to go to court. Before starting the procedure, it is advisable to check the blacklist of migrants on the department’s website.

Resolution of the issue in court

It will be necessary to cancel decisions, rulings, decrees, i.e. documents on the basis of which the preventive measure in question was introduced for foreigners. In case of illegal actions (inaction) of officials, a statement of claim should be filed according to the rules established by Art. 125-128, 220 CAS RF.

The decision on administrative expulsion should be appealed in the manner prescribed by the Code of Administrative Offenses of the Russian Federation. The content of the claim depends on the circumstances of the particular case. The document must indicate information about the court, the applicant, and also set out in detail the reasons why previously made decisions should be declared illegal (invalid).

How to check if you are on the list?

Often, when going through customs control at the border, a person may find out that he is not allowed to enter due to his presence on the black list. Which can entail serious expenses, because most of these people go to earn money. And to avoid such incidents, it would be more logical to prudently check yourself to be on the list.
