Will there be a salary increase for prosecutors in 2021?

The pension for prosecutors in 2021 and the latest news about how the conditions for its appointment have changed have become the subject of discussion among financiers and legal experts. For several years the government has not introduced any innovations to the pension provision of prosecutors. Time will tell what consequences this government decision will have, but for now it is important to familiarize yourself with the information and understand what the legal representatives of the prosecution can currently count on.

How does the law regulate prosecutor's pensions?

To understand the work procedure of procurator bodies, rewards, punishments, state control over their activities, as well as the procedure for retirement, you should familiarize yourself with the following list of federal laws:

  1. Federal Law No. 406 of December 20, 2017. The latest version of the law contains complete information about the activities, structure, work procedure and responsibilities of prosecutors, including the military.
  2. Federal Law No. 2202-1 dated December 27, 2018. This federal law came into force on January 8, 2019 and contains all the latest changes made by the government to the work procedure of prosecutors.
  3. Law of the Russian Federation of February 12, 1993 N 4468-I. The most informative will be the 2021 edition (the last change was made on December 20, 2017) with all the amendments. The law regulates the procedure for retirement, pension entitlements and government benefits for the military, fire brigade employees, employees of the judicial system, employees of internal affairs bodies and the drug and psychotropic drug control service.

Pensions in March 2021

The next increase will take place in the spring - in April, social pensions will increase by 2.4%. For now, this is only a projected level, since it depends on the increase in the cost of living over the past year. If the expected growth turns out to be correct, then the average payment will be 9.2 thousand rubles.

Russian pensions increased by seven percent on the first day of the new year. This figure – 7.05% – is almost twice the inflation rate and gives an average increase of one thousand rubles per month. However, as Labor Minister Maxim Topilin emphasized, 1,000 rubles is an average figure: for some, the pension increase will be higher, for others a little lower.

Conditions for receiving a pension

State prosecutors may retire under the following conditions:

  1. Retirement age is approaching. The prosecutor's retirement age is 45 years old, while the total length of service in the public prosecution service must exceed 12.5 years.
  2. Retirement based on length of service. In the prosecutor's office, length of service is considered to be 20 years of continuous experience.
  3. Upon dismissal due to deteriorating health. In this case, the pensioner receives disability payments until he reaches retirement age. From this moment on, the disability pension automatically changes to a labor pension, but its amount should not be less than the payments received for disability.
  4. The reason for receiving severance pay may be resignation or layoffs in connection with the reform. Pre-retirees who have no more than five years left before their legal leave can apply for early retirement. To do this, you need to write an application to the Pension Fund of the Russian Federation with an explanation that there are no new official appointments and it is impossible to obtain a position in connection with the reform (or for other objective reasons).
  5. Prosecutors with twenty years of work experience who continue to work can apply for a pension bonus of 50% of their salary while maintaining their job.
  6. The survivor's pension is paid to the families and dependents of the prosecutor in the event of his death. Based on Federal Law No. 173 of December 17, 2001, paragraph 31 on the loss of a pensioner’s breadwinner, all persons dependent on the deceased prosecutor receive 30% of the amount of his pension. Minor dependents will receive a survivor's pension until they reach adulthood. Persons of retirement age and disabled people receive payments for life.

Salaries of prosecutors in 2021

Justice cannot exist without the position of prosecutor. Prosecutors have both a huge list of obligations and a huge responsibility. The majority of citizens are of the opinion that the salary of a prosecutor is quite high.

A prosecutor has many different job responsibilities. The most basic of them are:

  1. Conducting prosecutorial checks.
  2. Analysis of cases that were transferred by investigators, drawing up an indictment. This conclusion will subsequently be handed over and presented during the court hearing.
  3. Search for violations of current legislation in certain cases.

Who is entitled to a prosecutor's pension?

Only those specialists who work in the following positions can apply for a pension for state prosecutors:

  1. The Prosecutor General and all members close to him.
  2. Head of management.
  3. The head of the structural unit, his deputies and advisers.
  4. Military prosecutor.
  5. Criminologists of various categories.
  6. Lawyers.
  7. Investigator for particularly important cases.

The remaining employees, in whose work books none of the above-mentioned positions appear, are not entitled to apply for a prosecutor's pension, even if they are employees of the prosecutor's office or the judicial system. For example, secretaries, cleaners, PC operators, etc.

Pensions for prosecutors from February 1, 2021

Although huge increases are not expected in the near future, the total increase in pension benefits from January 2021 to 2020 is. will be 12%. This is where the gossip begins, related to the “six-figure pension amount for employees of the Prosecutor’s Office and the Investigative Committee of the Russian Federation.”

If we take as an example the self-determination method presented earlier, by simple arithmetic calculations you can get a six-figure amount even before the increase, but this only applies to isolated cases. For example, an employee who holds the position of General Counsel of Justice and whose length of service exceeds 20 years will quite naturally receive state support consisting of exactly this sum of figures—six.

Pension amount

The calculation of the prosecutor's pension in 2021 is carried out according to the formula: the employee's salary, summed up with all allowances, is multiplied by the coefficient set for representatives of prosecutorial positions (80%). Employees of the prosecutor's office are entitled to an official bonus and a bonus for length of service.

In order to independently calculate the size of your future pension, it is not enough to know the position and salary of a prosecutor’s office employee. In this matter, the reason for retirement, the total length of service in the prosecutorial system and in prosecutorial positions in particular are of great importance. In addition to the job coefficient, former prosecutorial employees are entitled to a bonus for continuous work experience.

Table 2. Amount of bonuses for length of service

From 5 to 10 years35
From 10 to 15 years45
From 15 to 20 years55

Example. Before retiring, Ivan Ivanovich worked for thirty-three years as a junior lawyer in the prosecutor's office. His salary was 25,000 rubles. Pension payments for the specified period will be calculated as follows:

25,000 * 19% = 4,750 rub. (official bonus) 25,000 * 70% = 17,500 rub. (continuous service bonus) 25,000 (salary) + 4,750 (position bonus) + 17,500 (service bonus) = 47,250 rubles. (base for calculation) 47250 * 80% = 37800 (pension payment)

In addition, prosecutors receive bonuses for various achievements:

  • receiving awards and medals - a one-time payment of seven salaries (the average salary of a prosecutor in 2021 was 60 thousand rubles. Accordingly, 60,000 * 5 = 300,000 rubles);
  • for receiving an honorary title - an increase of 5% of the salary (60,000 * 5% = 3,000 rubles);
  • defense of an academic degree - an increase of 5% of the salary (60,000 * 5% = 3,000 rubles);
  • work under special conditions - the coefficient is 175% of the salary (60,000 * 175% = 105,000 rubles);
  • recognition of high achievements during the period of work - the coefficient is set to 50% of the salary (60,000 * 50% = 30,000 rubles).

Increase in pension benefits for prosecutorial employees in 2021

In 2021, an increase in pensions for prosecutors, prosecutorial employees and investigators of the Investigative Committee of Russia is provided. Payments to employees of the prosecutor's office have not been indexed for several years. If in 2021 the average pension benefit for a district investigator and prosecutor was 20,000-22,000 rubles , then from February 1, 2019, thanks to the rank fee, it will be 26,000-29,000 rubles .

Features of pensions for military prosecutors

Until 2021, military prosecutors left their posts for a well-deserved rest upon reaching retirement age as military pensioners. They were entitled to all the benefits and allowances due to military personnel.

It should be noted that the military pension is significantly lower than the prosecutor's pension!

In 2021, in connection with the state reorganization, military prosecutors and investigators were included in the structure of the Prosecutor General's Office and the Investigative Committee; this event equated the rights of military prosecutors and investigators with the rights of their civilian colleagues. An important difference in calculating the pension of a military prosecutor is the fact that his salary depends on promotion of rank and military merit. Military leadership can retire based on length of service, having at least 20 years of experience behind them. The pension amount will be calculated as follows: 54% of salary + 3% for each year exceeding twenty years.

The regional coefficient is added to the standard pension calculation formula if the service took place in the northern regions of the country. In military units with special conditions of service, 3 years of service are counted as 4. For disabled military personnel, social benefits are provided. The payment coefficient depends on the disability group confirmed by the medical commission:

  1. The first is 300% of the social pension.
  2. The second is 250%. from social pension.
  3. Third - 175% of the social pension.

The size of the social pension in 2021 is set at 9,215 rubles. Accordingly, a disabled person of the first group will receive a monthly pension in the amount of 27,645 rubles, a disabled person of the second group - 21,229 rubles, a disabled person of the third group - 16,126 rubles.

No indexation was carried out in 2021. The increase in military pensions in 2021 is planned by 4.3%. If today the average pension for former military personnel is 17,000 rubles, then in the future it will increase to 17,731 rubles.

Payment amount

The amount of length of service depends on a number of factors:

  • length of service;
  • the amount of monetary allowance in full at the time of retirement;
  • grounds for retirement.

If an employee ceases service due to the required length of service, then the amount of his income will be set at 50% of the salary for the last position held. He is also entitled to an additional 3% for each year of service beyond the established 20 years. At the same time, there is a maximum limit on the amount of payments, which is 85% of the amount of allowance.

If there are only 12.5 years of service and 25 years of experience, the calculation of the amount of security is carried out slightly differently. The minimum amount is also set at 50% of the salary of such an employee. Such persons can receive an additional 1% for each calendar year of total work experience over 25 years.

From October 1, 2021, there was an increase in military pensions , including payments to former employees of the prosecutor's office by 4.3%.

The calculation of the amount of payments includes the official salary, salary for the assigned rank, as well as a monthly allowance for the length of service. The minimum amount of security is equal to the calculated amount of the pension established by the legislation on pension provision for military personnel.

Possible surcharges

Additional payments for length of service as a percentage of the calculated amount are established in the event of disability due to injury received during service. Disabled people of group I – 300%, II – 250%, III – 175%.

In addition, the following surcharges are established:

  • disabled people of group I (except for the cases indicated above) - 100% of the estimated pension;
  • persons over 80 years of age – 100%;
  • for unemployed people with dependent disabled family members - 32%, 64% and 100% for 1, 2 and 3 (or more) dependents, respectively.

The supplement for dependents is due only if the dependent himself does not receive any type of pension (social or insurance).

Calculation of the pension of a prosecutor's office employee

To obtain accurate figures for future or due payments, you need to know several indicators. In general, the formula for calculation can be written as follows:

P =DD * (50% + PS) + D,

Where:

  • P – the amount of payments due;
  • DD – amount of monetary allowance;
  • PS - additional interest for length of service above the minimum required;
  • D – additional payments (if they are required by law).

Let's consider an example of calculating a long-service pension with an allowance of 30,000 rubles, 25 years of service in the Prosecutor's Office, not working, with 2 dependent minor children.

We get the following numbers:

  • 15% additional salary for having more than 20 years of service;
  • 64% of the estimated pension for 2 dependents.

With an estimated amount of 5,034 rubles. 25 kopecks per month (figure as of 2021), the additional payment for dependents will be 3,221 rubles. 92 kopecks T

Now let's calculate the total:

30,000 rub. * 65% + 3,221 rub. 92 kopecks = 22,721 rub. 92 kopecks

You can also use a calculator to calculate your due payments, which are available on unofficial services on the Internet.

Additional payments and benefits for retired prosecutors

Retired prosecutors can go to a sanatorium for free, reimburse the cost of medicine and receive free medical care

Prosecutors who have retired due to length of service are entitled to the following benefits:

  1. Free provision of medical services in any municipal medical institution; all medical expenses are paid from the federal budget.
  2. The right to receive a voucher to a sanatorium. The voucher is issued on the basis of a commission from the social insurance fund based on the health status of the applicant.
  3. The costs of purchasing medicines recognized as vital can be fully reimbursed from the federal budget.

Persons who retired with the rank of labor veteran pay only 50% of utility bills for housing in their property. They can also take advantage of free dental treatment and prosthetics at a state dental clinic. Labor veterans have first priority when entering a nursing home.

Pensions for prosecutors from February 1, 2021

The reason for the emergence of numerous rumors on this issue was a bill proposing to increase the pensions of Russian prosecutors. The tabloid press and users of Internet forums and social networks are developing an unfounded global problem without any basis. In fact, the situation looks different.

  1. The salary level varies in the range of 100,000 rubles, while the salary at the time of reaching retirement age, in accordance with his position, is only 35,000 rubles.
  2. The value of the coefficient for the existing rank, according to table No. 1 given earlier, is 23% - equal to 35,000 rubles. * 23% = 8,050 rub.;
  3. The value of the length of service coefficient according to table No. 2 given earlier is 45% - equal to 35,000 rubles. * 45% = 15,750 rubles;
  4. By adding the 2 values obtained and the previously calculated salary, the following amount is determined: 35,000 + 8,050 + 15,750 = 58,800 rubles;
  5. From the ratios established by the laws of the Russian Federation in the amount of 80%, the following amount is obtained: 58,800 * 80% = 47,040 rubles.

What changes will affect prosecutors' pensions in 2021?

In 2021, it is planned to make a number of changes related to the retirement of Russian citizens. This is due to the increase in the number of years of service. In different structures, the retirement age will change; prosecutors will retire according to their length of service no earlier than after twenty-five years of continuous service, but not earlier than 45 years. An employee of the prosecutor's office is entitled to pension payments only after 12.5 years of service.

Indexation of pension payments will affect all pensioners in the country. It is planned to spend more than three billion rubles this year and approximately the same amount next year to increase the pensions of former prosecutors. Pension payments will increase by 30% on average. Indexation will also be carried out in terms of increasing the salaries of working prosecutors by approximately 4%. In 2021, the average pension for state prosecutors was 30,000 rubles. After indexation in 2021, the average additional payment will be 9,000 rubles.

Indexation of pensions for working retired prosecutors

Starting from 2021, on the basis of Federal Law No. 385 of December 29, 2015, working pensioners can receive pensions and wages, but indexation of monthly pension payments is not carried out for them. The same law applies to retired prosecutors. After the dismissal of a pensioner, the amount of pension payments is recalculated within three months, taking into account all previously missed indexations. The pensioner should receive an increased pension the very next month after dismissal, but if by this time the pension fund employees do not have time to recalculate, the difference will be paid later, not exceeding six months of waiting.

For working pensioners, the pension is not indexed

Example. Petr Petrov quit his job in January and immediately reported this to the pension fund. From February of the same year, Petrov should receive a pension, taking into account all previously missed indexations, but the pension fund employees did not have time to carry out the necessary calculations. In February and March, the pensioner received the same amount of pension payments as during his working life. In April, Peter receives a pension, taking into account the recalculation made, and an additional payment in the amount of the difference between the due pension amount, taking into account all indexations for February and March, and actually received.

Establishment and payment of pensions: excerpts from the law

News about the bill on pensions for prosecutors

Currently, the State Duma is considering a draft law that provides for an increase in pension payments for employees of the prosecutor's office. For this reason, media representatives developed a global problem, reporting that it is planned to increase the amount of support for such citizens several times.

In reality the situation is different. The journalists' conclusions have no justification. In fact, the Government of the country proposed to increase the amount of security for retired prosecutors by 12% in 2020.

The justification was that for several years until 2019, this category of citizens did not receive an increase. Some claim that employees of the prosecutor's office receive pensions of more than 100,000 rubles.

In practice, you can find such a payment amount, since the amount depends on the length of service and the amount of salary during the work activity.

Currently, this draft law has not yet been approved.

How has the size of the benefit changed over the past 3 years?

The pension amount for prosecutors in 2021 is equal to 80% of the previously established salaries. The determination of values is carried out according to rank and length of service. In this situation, you need to understand that the interest rate in this situation will be different.

Average

The amount of earnings and salaries of prosecutors can vary significantly and depend on various factors, ranging from rank to length of service or position held. For example, an investigator for particularly important cases can receive up to 350,000 rubles, the head of a department up to 400,000, and the general - more than 500,000.

Every year the Russian government makes amendments to federal laws. The essence of the amendments and innovations is to ensure that former and current employees of the department and members of their families do not spend money on travel to vacation spots. This includes state military sanatoriums and medical institutions. But such projects were not partially supported by the Cabinet of Ministers.

This year the bill was approved. Prosecutor's office employees will be able to count on free travel on any type of transport once a year. But such a benefit will be provided not to employees of the prosecutor’s office in all regions, but to those who serve in the Far North or other areas with an unfavorable climate.

The prosecutor has the right to count on a pension based on length of service or on other grounds. Upon reaching certain years of work in the prosecutor's office, the state awards a pension. If the applicant is already entitled to a pension and he has 20 years of service or more, he is entitled to a monthly supplement in the amount of half the pension.

As for severance pay, it will be issued upon retirement, establishment of a disability group, resignation and poor health. The size of pensions for prosecutors in the country is equal to 80% of the monthly salary, which also includes bonuses, all types of incentives and allowances.

If there is no length of service, but work experience as a prosecutor allows you to apply for a minimum pension, the pension is calculated based on the number of full years worked.

Due to the crisis and sanctions, the increase in pay will be 5.5% (the government planned 15%). Starting from 2021, a pension supplement of 2,500 rubles per month has been introduced. This increase cost the budget 500 billion rubles annually.

The State Duma also adopted a bill that provides for compensation of expenses for employees of the prosecutor's office and the Investigative Committee for trips to sanatorium and resort organizations. The amendments were developed by the Ministry of Finance.

Currently, military personnel and law enforcement officers have the right to pay for travel to the place of treatment and rehabilitation in medical institutions.

In two sanatoriums of the Prosecutor General's Office, 6,000 people can be treated annually, of which more than 65% have the right to pay for travel to and from their vacation destination.

Benefits for employees of the prosecutor's office in 2021 will include a mandatory pension supplement, which will be 5.5% of the basic salary. The size of the pension itself is 80% of the employee’s official salary. To receive all bonuses and the established pension, the length of service must be at least 25 years. If the work experience is shorter, it can be compensated by work experience as a prosecutor.

To receive additional benefits and salary increases, you must have additional higher education. This condition is not mandatory. Also, employees of the prosecutor's office can receive not only benefits for medical care, but also seek help from the hospital for free. This right can be exercised not only by employees of the prosecutor's office, but also by members of their family.

Also, employees of the prosecutor's office are granted extraordinary leave. It is paid in full in accordance with current legislation. To take advantage of the benefits, you must have the appropriate documents and be registered as an employee of the prosecutor's office.

Prosecutors and investigators will have their pensions increased

Former employees of the prosecutor's office are interested in the amount of benefits that will be paid next year. The decision on indexation also applies to employees of the Investigative Committee. Pension provision for employees of the prosecutor's office is carried out in the same manner as for employees of the Ministry of Internal Affairs. The amount of benefits depends not only on length of service. The size of payments is influenced by the reasons for retirement. The increase in pensions for prosecutors this year will take place on February 1.

A former prosecutor may be entitled to payments if he has reached retirement age. The state provides financial support to employees who have become disabled. The reason for dismissal may be poor health. If such events occur, the state will pay severance pay to the former employee.

Its size is set in accordance with the duration of work. To receive 5 salaries you must work for at least 10 years. Employees who have accumulated years of experience can count on financial assistance in the amount of 10 salaries. Prosecutors who have worked for 15 to 20 years are entitled to receive 15 salaries.

There will also be a bonus for length of service. The state pays 20 salaries to more experienced employees. Former employees are interested in the question of what the pension for prosecutors will be this year. Recent news indicates positive changes that will affect older people. Increasing pensions for prosecutors will require 2.5 billion per year.

Funds for these purposes are already included in the budget. The state limits the age at which a prosecutor's office employee can retire. In accordance with current legislation, an employee will not be able to receive payments until he turns 45 years old.

You must work in the prosecutor's office for at least 20 years. The government has introduced a bill that determines the procedure for indexing the pensions of prosecutors in the year. The salaries of retired employees of the Investigative Committee were not increased.

Moreover, former prosecutors are included in the same group as retired military personnel. The prosecutor's pension will increase this year under the same conditions as for employees of the Ministry of Internal Affairs. Now the state has decided to consolidate the indexation of pensions of former prosecutors at the legislative level. This was announced by Vasily Piskarev, who holds the post of head of the State Duma Committee on Security. Payments for this category of pensioners will be increased under the same conditions as for military personnel.

Thanks to such an initiative, the state will achieve elimination of income inequality among older people. To apply for benefits, you must work as a prosecutor or an employee of the Investigative Committee for at least 20 years. The salaries of ordinary prosecutors depend on the salary of the first deputy prosecutor general. The same principle applies when calculating benefits to employees of the Investigative Committee. To increase pensions for former prosecutors and employees of the Investigative Committee, about 2.5 billion will be required.

However, pensioners should not count on a significant increase in payments. After indexation, the prosecutor’s annual pension per year will increase by 1.5 thousand. Former prosecutors can count on an increase in the pension supplement from February 1 of the year. When calculating payments, the employee's class rank is taken into account. Specialists will receive benefits based on increasing factors. Indexation will also affect the additional payment for length of service. The amount of additional payments is included in the pension. Benefits Large family Tax on professional income from the year Tax changes in the year Tax deduction Prosecutor General of Russia Yuri Chaika proposed raising the salaries of prosecutors.

According to the publication, Chaika approached Prime Minister Dmitry Medvedev with a proposal to equalize the salaries of prosecutors and judges. If his initiative is approved, the monthly income of employees of the supervisory agency will increase two to three times, up to thousands of rubles. In his address, the Prosecutor General referred to the experience of foreign countries in which prosecutors and judges have equal rights. Dear readers! Our articles talk about typical ways to resolve legal issues, but each case is unique.

If you want to find out how to solve your particular problem, please use the online consultant form on the right or call the numbers provided on the website. It's fast and free! Another category of Russians retiring under special rules are security forces. At first we planned to write a text about how much money comes from the budget for the maintenance of all former and current employees of law enforcement agencies, but we decided to pose the question differently.

The fact is that pension reform may extend to them. By the year, along with raising the retirement age, ordinary Russians are preparing more changes for the maintenance of employees of the Ministry of Internal Affairs, the FSB and the Russian National Guard.

The draft law currently being developed by the government on raising the retirement age does not apply to security forces. However, two of our sources in the corridors of power said that in parallel, changes are now being discussed regarding the payment of departmental pensions to law enforcement officers. There are three scenarios for pension reform regarding security forces: In mid-June, it became known that the Ministry of Finance, together with the Ministry of Defense of the Russian Federation, are discussing increasing the minimum length of service for military personnel and security forces for retirement.

This was stated by First Deputy Prime Minister Anton Siluanov, who is also the Minister of Finance. This is one of the proposals that the ministry is currently working on. Let us note that when preparing the pension reform, it was the scenario of Siluanov’s ministry that was adopted by the government, because his team proposed raising the retirement age for women to 63 years, and for men to tee. Currently, the minimum length of service for security forces, which gives them the right to receive a departmental pension, is 45 years, for both employees of the Ministry of Internal Affairs and the FSB.

Due to the difference in length of service in the north and during combat operations, soldiers and officers can count on a state pension from the age of 40. However, it is known that amendments to increase the minimum length of service for internal affairs officers have already been prepared, but the government is still delaying their adoption.

Therefore, the pension reform will not bypass the Ministry of Internal Affairs. Apparently, the corresponding bill will be approved by the government this year.

Three years ago, the Cabinet of Ministers already considered the scenario of increasing the minimum service life from 20 to 30 years, but this option was rejected. In general, proposals to increase the lower limit of length of service for employees of the Ministry of Internal Affairs have been heard since the year when the country’s economy began to openly stagnate, which was compounded a year later by sanctions and falling oil prices.

The increase in length of service is associated with excessive expenses of the Ministry of Internal Affairs on salaries and pensions amounting to billions of rubles. The employees of the internal forces did not receive the expected indexation for the year. Or at least they could index the incomes and pensions of their employees. The cardinal option for pension reform for security forces is the abolition of departmental pensions as such. The most severe scenario for the development of events that the Ministry of Finance proposes is a transition from lifelong payments to law enforcement agencies to a one-time allowance with subsequent employment in the civilian world.

It has already been calculated that if such a proposal concerns not only law enforcement officers and penitentiary authorities, but also security and foreign intelligence service employees, fire departments, investigators, prosecutors, as well as the military, then billions of rubles will be saved in the budget every year! The general Russian public can only be pleased with this news: But not everything is so simple.

Indeed, among the security forces there is a category of staff employees who are not much different from office employees, and yet retire earlier.

Moreover, according to completely different rules than ordinary Russians. They serve in the Arctic or on submarines. The working conditions of these people, who risk themselves while carrying out the task, cannot be compared with those of the management team: However, when discussing the upcoming pension reform of the security forces, no one is going to pay attention to the specifics of the work.

Nowadays, one year of service in the north counts as two years of service, and a month during combat operations counts as three. And this is fair, because work in such conditions carries increased risks and should be rewarded more than the work of those who work in calm, familiar conditions. It is this preferential work experience of security forces that subsequently affects health and leads to disability.

To take advantage of these guarantees, they still need to be proven. Disability benefits are received by employees of the Ministry of Internal Affairs if it is established that the reason for classifying them into one of three disability groups was a work injury or illness received no later than three months after dismissal from service or from an injury received during service. We must understand that pensions for security forces are paid not from the deficit Russian Pension Fund of the Pension Fund of the Russian Federation, like all ordinary Russians, but directly from the federal budget.

Expenses for paying pensions to police officers and other security forces are included in the budget items of the relevant departments. And it is fair that it is the structures in which they served that have to pay for the crippled health of the security forces. And if someone still managed to survive in such difficult conditions, then they should receive a decent remuneration in order, in principle, to maintain a material bonus from performing these state tasks.

Rarely does anyone want to risk their health on patriotism alone. The pension service for guardsmen has not yet been created, so all aspects regarding payments are assigned to the Ministry of Internal Affairs.

Soldiers of the Russian Guard are classified as employees of the Ministry of Internal Affairs, which allows them to have all the additional payments of security forces. But most of it was spent on the management team: Now imagine the anger of the employees of the Ministry of Internal Affairs, who learn that they will have to endure these not the most favorable conditions for 5 years longer in order to receive their departmental pension. Simply because the government decided to save budget money on them.

Political scientists believe that from the very beginning of his powers, Vladimir Putin targeted the security forces: He actively cultivated an electorate that always faithfully voted for him in elections, and not only the employees themselves, but also their families, relatives, friends, etc.

Since the year when the internal troops of the Ministry of Internal Affairs were transformed into the Russian Guard, internal affairs bodies began to receive fewer and fewer privileges. It is planned that the guardsmen will receive the highest incomes among all security forces. We are gradually moving towards this. Before the structure itself had been created in January, at the end of the year the president decided to increase pension supplements for former National Guard employees by immediately by rubles - from rubles to rubles.

And from January 1, the president decided to further increase the allowance for retired guardsmen to rubles.

Legislation

  • The main regulatory act in force in the field of pension provision is Law No. 166-FZ of December 15, 2001. This document establishes the general types of government subsidies, the grounds for receiving them, the rights and responsibilities of citizens.
  • The Law of the Russian Federation “On the Prosecutor's Office” No. 2202-1 of January 17, 1992 is also in force. Article 44 establishes the basic provisions for pension provision for these employees. The amounts of severance pay have been established.
  • Pensions for prosecutors, like other employees of law enforcement agencies, are calculated on the basis of the provisions of Law No. 4468-I of February 12, 1993. Although the document does not directly identify employees of the prosecutor’s office, their state support after retirement is carried out in the same manner as for employees of internal affairs bodies.
  • The Pension Fund of Russia does not calculate payments based on length of service. There is an Instruction on the organization of work on pension provision in the prosecutor's office. It was approved by Order of the Prosecutor General No. 374 of December 4, 2009. This document establishes that regional pension services are being created in the system of this state body, which, together with financial and personnel structures, are engaged in transferring money to retired employees.

Insurance coverage for other employees

The remaining employees of the prosecutor's office who are not prosecutors, researchers and whose position is not a civil servant (administrative staff, cleaners, janitors, etc.) are entitled to old-age insurance.

The conditions, calculation and receipt procedure are the same as for civil servants, with the exception of the age of retirement and the requirements for length of service. The retirement age is 65 years for men and 60 years for women, and the length of service is at least 15 years. These values are valid at the end of the transition period under the bill on the new pension reform, which is carried out according to the schedule:

YearRetirement age, men, yearsRetirement age, women, yearsAmount of accumulated pointsMinimum required experience, years
2019615616,210
2020625718,611
202163582112
2022645923,413
2023656025,814
2024656028,215
202565603015

The length of service already includes not only work in government agencies, but also any periods of official employment, as well as engaging in entrepreneurial activity with the deduction of required contributions.

Thus, prosecutors and researchers are assigned a state payment, which is a percentage of their salary with the use of increasing and decreasing coefficients. The remaining employees are entitled to insurance benefits calculated using a formula depending on the number of accumulated points. To receive it, you must contact the personnel department or the Pension Fund in the case of insurance payments.

Question answer

Prosecutor's office employees are government employees who are supported by the budget. Payments of benefits for this category of citizens are carried out by analogy with the procedure for calculating pension payments for employees of the Ministry of Internal Affairs. Pensions of former officials are indexed annually, so their amount depends not only on length of service and the state of the federal budget, but also taking into account the reason for retirement. The next indexation led to the recalculation of pension payments. In this regard, a number of issues have arisen that will be covered in this article.

What time do prosecutors retire?

Until 2009, the Federal Law “On the Prosecutor's Office of the Russian Federation” (clause 2, article 43) established the age limit for prosecutors' office employees at 60 years. The State Duma introduced an amendment, increasing the retirement age to 65 years and allowing the extension of official powers to 70 years. However, you can retire based on disability and long service. But if a citizen finds a job again, then payments stop until dismissal from the prosecutor's office of the Russian Federation.

At the time of retirement, an organ worker must reach the minimum age of 45 years.

Pensions for prosecutors from February 1, 2021?

Decree of the President of the Russian Federation dated January 24, 2018 “On establishing coefficients applied to the amount of additional payments for class rank, taken into account when calculating the monthly pension supplement for certain categories of pensioners.” As stated by the Chairman of the State Duma Committee V.I. Piskarev, starting from February of this year, coefficients for calculating additional payments for rank have been assigned, which will increase annually. This means the higher the rank, the greater the pension. In addition, the government has enshrined indexation at the legislative level.

Thus, the Russian government set a course for increasing prosecutor’s pensions, which did not change until 2014. In turn, a law enforcement officer who wants to know his future pension can apply to the Pension Fund for this information. After dismissal, it is enough to provide the Pension Fund with a work book, salary certificate, SNILS, pension application and passport.

A table has been published with the timing of pension indexation in 2021: who will receive an increase and how much

In this regard, from August 1, 2021, working pensioners for whom policyholders (employers) paid insurance premiums in 2020 will receive an increased pension. However, the increase will only affect recipients of old-age and disability insurance pensions.

The maximum increase, which is made in August, is limited to only 3 points (pension coefficients), converted into cash equivalent. As of August 1, 2020, the cost of 1 coefficient will be 87 rubles 24 kopecks. Therefore, pensioners will not receive an increase of more than 261 rubles 72 kopecks (87.24 rubles x 3) from August 1, 2021.
