A temporary residence permit is a permit that allows foreign citizens to temporarily reside in Russia. A temporary residence permit in Crimea can be obtained on the basis of a migration card. When a foreign citizen crosses the border, a migration card is issued for him.

The temporary residence permit is valid for three years.

A temporary residence permit gives a foreign citizen the right to temporarily reside and work in Russia. Thus, it allows a foreigner to legally stay on the territory of the Russian Federation until receiving a residence permit or citizenship.

Which Ukrainians can count on a temporary residence permit in Crimea?

Obtaining a temporary residence permit in Crimea follows the same procedure as in any other Russian region:

  • according to quota;
  • without her.

Every year, the Russian government sets certain limits on the assignment of temporary status. All of them are distributed by region taking into account the demographic situation, economic development and population density. So, let’s say, the Crimean peninsula in 2021 can accept no more than 1,900 foreigners. At the same time, quotas for temporary residence permits for citizens of Ukraine for 2021 in Crimea are not established according to any separate rules. And this means only one thing - when the limit is exhausted, the acceptance of applications, including from Ukrainians, will be stopped until next year.

It is easier to obtain a temporary residence permit for citizens who have reasons to do so without a quota. The reasons may be:

  1. The person was born in the USSR or on Russian territory.
  2. People who were declared incompetent, despite the fact that their children live in Crimea.
  3. Citizens whose adult children have Russian citizenship and need guardianship because they have been declared incompetent.
  4. People from Ukraine who invest in the Russian Federation. The amount of investment is set separately.
  5. Citizens entering military service.
  6. Children under 18 years of age are allowed to live with their parents.
  7. Other cases provided by the state.

  • Comply with the residence requirement at the place of registration.
  • Undergo annual registration with the territorial body of the Main Directorate for Migration Affairs of the Ministry of Internal Affairs at the place of residence in order to confirm the status received.
  • Confirm annually income in the amount of the subsistence minimum per person and confirmed dependents living with them in the territory of the Russian Federation. The subsistence minimum is determined based on the amount established in the region of migration registration.
  • Stay in the country within the prescribed period. A foreign citizen who has a temporary residence permit has the right to freely cross the territory of the country. If you are absent from the Russian Federation for more than six months, the temporary residence permit may be cancelled.

A temporary residence permit may be granted again at the request of a person.

Extension of temporary residence permit

The stages of legalization in the Russian Federation can hardly be called simple. For this reason, many are interested in the question of whether it is possible to extend a temporary residence permit for a new period. Unfortunately, Russian legislation does not provide for such a procedure.

This means that Ukrainians with an expired temporary residence permit are required to leave Russia or have a document that will confirm the grounds for legal further stay on its territory.

Is it possible to extend the temporary residence permit?

Visitors from abroad who temporarily entered the Russian Federation legally do not have to worry about their status for only three years. This is the duration of recognition of their permit document (Federal Law of July 25, 2002 N 115-FZ “On the Legal Status of Foreign Citizens in the Russian Federation”, Article 6).

Migrants arriving in the Russian Federation fill out a migration card when crossing the border, which is the basis for staying on our territory for some time. The further existence of a foreigner on the territory of the Russian Federation is regulated by the 115th federal normative act. This law also applies to those who have the right to temporary residence. Article No. 6 directly points to this.

As you can see, there is no automatic extension of the temporary residence permit.

Briefly about RVP

From a legal point of view, a temporary residence permit can be represented as the legal right of a foreign citizen to reside on Russian territory for a strictly limited period of time.

It is worth noting that this stage of legalization in the Russian Federation is not the initial stage. It represents a logical continuation of some migration formalities. The process looks like this:

After the expiration of the period of permissible stay, all foreign citizens are required to leave the Russian Federation or provide a legal basis for their further stay. This is exactly what a temporary residence permit is.

A temporary residence permit looks like a stamp in a foreigner’s passport. Stateless persons receive a completely independent certificate, which confirms their right to temporary residence and proves their identity.

Reasons for cancellation

The most common reasons for cancellation of a temporary residence permit in Russia:

  • A temporary residence permit may be revoked if a foreign citizen has been outside the Russian Federation for too long. In accordance with the legislation of the Russian Federation, foreigners with a temporary residence permit can travel outside the Russian Federation for no more than 180 days per year from the date of issue of the temporary residence permit. If a foreigner stays outside the borders of the Russian Federation even for 1 day longer than required, his temporary residence permit will be revoked.
  • Cancellation of a temporary residence permit for a foreign citizen awaits if he lives and works in a region other than the one where the document was received. That is, for example, if a foreigner lives and works in St. Petersburg, and a temporary residence permit was issued in Moscow, he will face cancellation of his temporary residence permit in Russia.
  • A temporary residence permit can also be canceled if a foreign citizen has not submitted an annual notification of confirmation of residence under a temporary residence permit or has violated the submission deadlines.

Important!

A foreigner can change his place of residence upon request to the FMS, where he will need to submit an application indicating the reason for the change of residence.

Cancellation of status

In addition to the fact that, along with a stamp in his passport, a Ukrainian citizen receives a number of rights that allow him to lead a normal life and adapt to Russian society, he is also assigned a whole list of responsibilities. Failure to comply with the latter inevitably leads to penalties in the form of revocation of temporary status.

Here is a list of the main reasons that can cause cancellation:

  • providing false information or forged documents;
  • presence of an outstanding criminal record;
  • brought to administrative responsibility more than twice within one year;
  • bringing to criminal liability for committing a crime of medium or severe gravity;
  • violation of migration rules;
  • ignoring the submission of an annual mandatory notification to the Main Directorate for Migration of the Ministry of Internal Affairs about one’s presence in the Russian Federation;
  • exceeding the period of stay abroad and others.

We recommend that you study in more detail the reasons for canceling the temporary residence permit.

In a word, any actions that go beyond what should be the behavior of a migrant in the Russian Federation can provoke the cancellation of the validity of a temporary residence permit and, as a result, deportation.
