What is the easiest way to go to work in Poland?

In order to legally work in Poland, you need a visa type D. The easiest way to get it is through an official Oświadczenie invitation for 6 months.

Attention! A work visa to Poland cannot be the basis for employment in other Schengen countries.

What is an Oświadczenie invitation?

The Polish authorities have created a simplified scheme for opening work visas by invitation. Oświadczenie is a document issued by an employer in Poland. The Polish side contacts Urząd Pracy at the place of registration of the company and fills out an application for a work invitation for a specific person to Poland. To do this, you only need to provide a scan of the main page of your passport.

The invitation contains the following information:

  • Passport and contact details of the applicant.
  • Name of profession.
  • Name of the organization, employer contacts, place of work.
  • Working hours.
  • The type of contract that will be concluded.
  • The amount of the salary, which should not be less than the minimum. Now it is 2250 zlotys.

The completed original invitation is sent by mail and attached to the visa dossier. The applicant obtains a D05 visa, can go there and immediately begin his official duties.

There are several important points:

  • First, you must work for the employer who helped you obtain your visa. If you want to work for another company, you will need a new invitation.
  • Secondly, Oświadczenie is not yet the agreement itself. If you still plan to work, it is strongly recommended that you sign an employment contract upon arrival!

With Oświadczenie you have the right to work in the state for 6 months (180 days) during the year (with or without breaks). You have the right to spend 3 months in other countries of the Eurozone, and your immediate family (spouses, children, parents, grandparents) - to collect a Schengen dossier for the purpose of visiting a person who works in Poland.

Types of contracts

Employment in Poland is legal – this is, first of all, an employment contract. It guarantees social protection and a salary no less than the national minimum.

  1. Contract-assignment. The employer pays all contributions and taxes, but does not allocate money for sick leave and vacation. For workers for the season.
  2. Work agreement. Insurance is only available if an employment contract has been made. For a part-time job, not a main job in Poland.

There are two types of permits – long-term and short-term. You can only get a job in Poland using them.

  1. Up to a year. The employer is in charge of submitting the application. It may take up to a month to be considered. The main thing is that workers from Europe do not respond to the vacancy within 21 days. You can neglect the conditions for work if a highly qualified professional or a general worker is required.
  2. Up to six months. You can work in Poland only with an invitation certified by the Labor Bureau.

Important: the validity period should not exceed 3 years. Usually the price is no more than €47. It all depends on how long the person will be in Poland at work.

No need to make permission:

  • who received protection in Poland;
  • a person who is married to a citizen of the country;
  • those who have a Pole's Card;
  • military personnel, journalists, athletes;
  • official residents of the Eurozone, European Union;
  • those who have the right to stay.

Types of visas.

  • Category C (short-term Schengen) allows you to stay in the Schengen area for up to 90 days during each 180 -day period. When calculating the period of stay in the territory of the countries of the agreement, the period of stay on the basis of a residence permit or long-term visa (national) is not taken into account.
  • Category D (long-term national) gives the right to stay in Poland in total (one or more entries) for more than 90 days during the year, starting from the date of first entry. In addition, for movement within the territory of other Schengen countries no more than 90 days during each 180-day period, which is counted from the date of entry into the territory of the countries of the agreement. The most common Polish visas today are: tourist, shopping (from 2021 replaced by tourist when extended) and business . If certain conditions are met, you can get a visa for up to 5 years!

For a long stay in Poland for the purpose of work or study, you will need a visa type D (national visa).
It is usually issued for a period of up to a year. It is the type D visa that allows you to stay in the country for the entire period of validity. The visa can be single-entry or intended for multiple visits to the country.   • stay in the territory of the Schengen countries for up to 3 months within six months.

The main difference between a short-term visa and a long-term one is the length of stay. A regular tourist Schengen visa for a year is a short-term visa that allows you to stay in the country for up to 90 days every 180 days. A type D visa to Poland, on the contrary, is long-term - this means that you can freely stay in the country for the entire period of its validity, and also, depending on your purpose, legally work or study. Procedure for submitting documents for a visa

The procedures for applying for a visa to Poland for Ukrainians may differ depending on the type of permit. Detailed procedures are described in the articles linked above. Here we will only recall the main points common to all cases.

There are two ways to apply for a work visa:

  • Directly to the consulate.
  • Through PPVA (visa center).

When submitting to the consulate, you only need to pay the consular fee, which for citizens of Ukraine is zero (foreigners will have to pay 80 euros). At the same time, the queues at the consulates are much longer, and you will have to submit an application form through a special system e-konsulat.gov.pl. In the case of a PPVA, everything will go much faster, and the visa center staff can help you fill out the application form (as a separate paid service).

Submitting documents by mail

This method exists and is a variation of obtaining a visa through the PPVA. The service is offered to Ukrainians by the Nova Poshta courier service.

The essence of the method is that when paying the fee, you also select the method of submission - in person or via mail. In the second case, a dispatch day is set, on which the applicant comes to the post office and hands over a package of documents.

The post office sends it to the visa center, where an initial check takes place, then the documents are sent to the consulate for a final decision. If the decision is positive, the documents with the visa already issued are returned via the return route, with the possibility of delivery to the sender’s home (office).

Types of Polish work visa

  • Category E – issued to those who have previously worked in the country on a legal basis;
  • category B – for workers who can work in management;
  • category C – issued to foreigners who are transferred to a Polish branch from one or another international company;
  • Category D – for employees under a contract for a clearly defined period of time;
  • type E – short-term visa, the validity of which cannot exceed three months.

There used to be another type of work visa issued specifically for researchers and teachers, but this has been abolished since 2015.

Currently, there are only 3 types of visas that allow official employment:

  1. By off-season invitation . Implies working up to six months per year in industries that do not provide seasonal employment (D05A visa).
  2. By seasonal invitation . The Government of the Republic of Poland establishes the sectors of the economy in which seasonal work is permissible. This type provides for official employment for up to 9 months a year (D05B visa).
  3. By voivodeship invitation . Implies year-round employment.

A business visa, work on a Pole Card, etc. authorize legal stay of other types and are not considered in this material.

The mentioned types of visas have one thing in common - each of them requires an invitation to work : in the first case from the employer, in the second from the Voivode of the area where the actual employment will take place.
