What is SNILS and what is it for?

The labor legislation of the Russian Federation prohibits requiring other documents from a potential employee during employment.

According to Art. 11 of the Labor Code of the Russian Federation, labor legislation and other acts containing labor law norms do not apply to persons working on the basis of civil law contracts.

Thus, the insurance certificate of compulsory pension insurance (SNILS) is a document required when concluding an employment contract or civil servants' agreement.

In accordance with Federal Law No. 115-FZ of July 25, 2002 “On the legal status of foreign citizens in the Russian Federation”, during the period of labor activity in relation to a foreign citizen, the employer must accrue insurance contributions to the Pension Fund of the Russian Federation.

Is a citizen of Belarus always subject to compulsory pension insurance?

The procedure for registration and receipt of SNILS by foreign citizens is set out in Federal Law No. 167 “On compulsory pension insurance in the Russian Federation”. After concluding an employment contract, a foreign citizen is obliged to notify the employer of his desire to participate in the Russian pension program. After this, the employer must submit to the Pension Fund the employee’s questionnaire in form No. ADV-1, filled out by the applicant for a pension and confirmed by his signature.

If the applicant does not speak Russian, he has the right to fill out the application form in his native language, transferring into it the necessary data from the identity document. However, in this case, the application must first be submitted to a notary company, where a notarized translation of the application form into Russian will be prepared.

In addition, the employer is required to submit documents in the ADV-6-1 form to the Pension Fund within two weeks from the date of employment of the citizen. Within three weeks from the date of transfer of documents, the Pension Fund prepares a pension certificate with a unique SNILS number assigned to it for a foreign citizen.

Representatives of near and far abroad, employed in accordance with Russian legislation, have the right to independently apply to the Pension Fund to obtain SNILS. It is enough to select the local branch of the Pension Fund of the Russian Federation and contact it with an identification document, as well as a work book with a note about employment in Russia.

If the applicant’s personal documents are drawn up in a foreign language, it is necessary to notarize their copy translated into Russian. SNILS will be produced and issued within the next two weeks after the documents are submitted. It is important to note that neither the employer nor the Pension Fund has the right to refuse a foreign citizen to receive pension accruals.

Unfortunately, it does not seem acceptable today to become the owner of SNILS by visiting the Unified Government Services Portal. And in principle, you can’t apply for it via the Internet. This procedure is intended to be carried out exclusively under the condition of individual presence.

Then the Pension Fund division has three weeks to prepare the certificate, and the employer, one week after accepting the document from the fund, hands it over to the newly insured against signature. If the employee has already become a former employee by the time he receives the certificate with the number, the ex-employer informs him about the arrival of the expected one and keeps the certificate in the citizen’s personal file until the answer.
