How to obtain a certificate of USSR citizenship in 2021

All citizens of the Russian Federation born before 1991 have USSR citizenship from birth. Not a single person filed an application to renounce USSR citizenship and accept citizenship of the Russian Federation. This fact indicates that this category of the population of the Russian Federation is still citizens of the USSR with all the rights and responsibilities endowed by this state, they have the right to use the subsoil, natural and water resources, and land. In the article we will look at how to obtain a certificate of USSR citizenship, where to apply to obtain a certificate, and what documents are required for this.

How to obtain a certificate of USSR citizenship

To confirm Soviet citizenship, it is possible to obtain a certificate from the territorial branch of the migration service. To do this, you need to fill out an application indicating the reason for issuing the certificate, your full name, date of birth, place of residence, as well as the following data:

  • whether the applicant was a citizen of the USSR (by date of birth), if positive status, then on the basis of what documents;
  • on what basis was the Russian Federation passport issued;
  • whether citizenship of the Russian Federation or renunciation of citizenship of this state has been issued;
  • whether an application for renunciation of citizenship has been submitted according to the procedure.

To speed up the process of work of government agencies, you need to attach copies of all pages of your existing Russian passport. To receive a correct response from the migration service, all requests must be formalized unambiguously and it is better to submit several separate requests than one general one, for which you can receive a regular unsubscribe. A citizen can create similar queries shown in the table.

If a refusal is received to provide a citizen with this information, which the relevant authorities are required by law to provide, you can go to court with a claim for violation of the citizen’s rights in providing information, which entails administrative liability, as well as a violation of equality of human rights and freedoms.

Conditions for obtaining Russian citizenship for those born in the USSR

Firstly, through Decree of the President of the Russian Federation N 183 “On determining, for humanitarian purposes, categories of persons who have the right to apply for admission to citizenship of the Russian Federation in a simplified manner” dated 04.24.2020, citizens of the DPR/LPR received the right to a simplified procedure for granting citizenship, respectively, including those who previously had USSR citizenship (that is, first received a passport before 1992 in the national republics of the USSR). However, in order to use the procedure on this basis, it is still necessary to obtain a passport (and citizenship) of the LPR/DPR before submitting such an application.

Regarding the topic of the article, it would not be amiss to make an addition in connection with the release of recent Decrees of the President of the Russian Federation regarding the simplification of the procedure for obtaining Russian citizenship by persons who are also directly related to those categories of citizens who previously had (received) Soviet citizenship.

Legality of forced change of passports

The presence of a Russian passport by a citizen is not proof of citizenship. The only supporting document is a birth certificate. A passport can be a proof of citizenship only if it has a special stamp.

In a rule-of-law state, consideration of the issue of granting citizenship to an applicant occurs upon his written request. It is impossible to force a citizen to change his passport from one state to another. This is a violation of human rights and freedoms. That is, no government has legal grounds to deprive a person of his existing citizenship and make him a citizen of another country. According to international law, the fact of such a violation during the forced change of USSR passports to Russian Federation passports turned former citizens of the USSR into violators of USSR legislation.

Confirmation of citizenship and features of the procedure in 2021

If papers confirming citizenship are needed by a person abroad, and their passports have lost legal force, such documents can still be used as evidence. However, they should be accompanied by a well-written application to the consulate.

Almost all residents of the Russian Federation know that confirmation of citizenship occurs with the help of a national passport, which has a special mark. In addition to an identity card, an adult can prove his Russian citizenship with the help of a foreign, diplomatic, service passport, seaman's certificate, i.e. a document indicating that he is a citizen of the Russian Federation.

Peculiarities of registration and issuance of USSR passports

By letter dated March 18, 2021, the Government of the Russian Federation indicated the reasons why the mass issuance of USSR passports is impossible. The main reason is the violation of the Constitution of the USSR by citizens who issued Russian passports, having received a legal connection with a foreign state. As a result, they cannot take advantage of the rights and responsibilities of the USSR and are violators of the laws. The point is not that the USSR Government refused to issue a passport to a citizen, but that former citizens of the USSR, against the legislation of the USSR, received citizenship of another state.

Until such citizens surrender their passports of foreign states at the place of receipt and renounce this citizenship, they will not be able to obtain a USSR passport. However, if the applicant wishes, it is possible to obtain a certificate of USSR citizenship by going through a complex procedure of paperwork and drawing up an endless number of letters to government agencies.

The USSR is a SOURCE OF POWER for the citizens of the USSR, giving them the right to defend their land, property, and rights before the occupying power. This power rests on violence, and not on the will of the people. She cannot even judge us, just like an Arab or a German, because for us they are foreigners holding power by force, disposing of our wealth.

The Russian Federation passport is issued by the migration service; in the “place of residence” column, “registration” is recorded, instead of “registration”, as was the case in the USSR. This means that everyone with a Russian passport is MIGRANTS, without any rights or state protection. The so-called “Russian Federation passport” itself is just an “identity card”, an “ausweiss” that allows you to move around the occupied area.

Confirmation of Russian citizenship

From the point of view of Russian legislation on citizenship, such circumstances as a person’s residence for the entire period of time after acquiring Russian legislation outside of Russia are also of no importance; obtaining, within a specified period of time, citizenship of any other foreign state or the status of a stateless person, as well as obtaining any documents proving identity and citizenship, etc.

When presenting information on issues of confirming Russian citizenship, we, if necessary, will make reference to the norms of the current Russian legislation on citizenship, namely, the Federal Law “On Citizenship of the Russian Federation” dated May 31, 2021 No. 62-FZ (hereinafter referred to as – Federal Law) and on the Regulations on the procedure for considering issues of citizenship of the Russian Federation, approved by Decree of the President of the Russian Federation of November 14, 2021 No. 1325 (hereinafter referred to as the Regulations).

Request to the Main Directorate for Migration of the Ministry of Internal Affairs of the Russian Federation

Published: 2020-01-14 Duration: 07:09 Request to the Main Directorate for Migration of the Ministry of Internal Affairs of the Russian Federation Confirmation of citizenship of the USSR. Taking into account all the negative events after March 17, 1991, the All-Union referendum on the preservation of the USSR, associated with the dissolution (collapse) of the authorities and management of the USSR on the basis of Resolution GS-13 of November 14, 1991, an unconstitutional body of the State Council of the USSR headed by the first and last, unconstitutional chosen by the President of the USSR, Mikhail Sergeevich Gorbachev and his accomplices, who headed the Union Republics within the USSR, after which they created illegitimate Legal Subjects, who issued their ausweiss in the form of civil passports of the Navoi states.

Taking into account that from the moment of his birth, according to the Birth Certificate, series I-ML No. 410221, issued on 01/08/1988, in the USSR (RSFSR) on the basis of the USSR Law “On Citizenship of the USSR” [1] dated 04/23/1990 No. 1528-1 , I, Rudneva Anna Sergeevna, am a citizen of the USSR, born and living in the RSFSR, part of the USSR (See Law of the RSFSR “On Citizenship of the RSFSR” [2] dated November 28, 1991 N 1948-I). According to the USSR Law “On Citizenship of the USSR” dated May 23, 1990 No. 1518-1, any change of citizenship, both voluntary and forced, is formalized by Resolutions of the Supreme Soviet of the USSR or similar structures of the Union Republics within the USSR. I declare the following about myself: I, Rudneva Anna Sergeevna, as a citizen of the USSR, born and living in the RSFSR, part of the USSR, have never applied to the Supreme Soviet of the USSR in accordance with the Law of the RSFSR “On Citizenship of the RSFSR” dated November 28, 1991 N 1948- I, nor to the Supreme Council of the RSFSR in accordance with the Law of the RSFSR “On Citizenship of the RSFSR” dated November 28, 1991 N 1948-I). Consequently, both in the Bulletin of the Supreme Soviet of the USSR and in the Bulletin of the Supreme Soviet of the RSFSR there is no resolution on changing my citizenship. Taking into account that the USSR Law “On Citizenship of the USSR” dated May 23, 1990 No. 1518-1, did not provide for dual citizenship or change of citizenship in any other way except as described by this law, then I was and remain forever a citizen of the Union Soviet Socialist Republics. Any attempt by anyone to make me a citizen of another state is subject to criminal liability under Art. 64 of the Criminal Code of the RSFSR (Treason), especially when the authorities and administration of the USSR began to be restored

I am a citizen of the USSR

It’s strange like “The main thing is to ask the right way in order to get the right answer.” Who needs the answer?? It seems to me that if you ask directly, “What citizenship do I have,” then the answer will be that it is the Russian Federation. So twist it however you want.

Hello. My question is the following. I was born in Kaz. SSR. Then the USSR passport was changed to the Ausweiss of Kazakhstan. At 98 he moved to Russia for permanent residence. Now should I send questions about citizenship to Kazakhstan or Russia? And if I renounced Kazakhstani citizenship, then I probably accepted Russian citizenship. How to deal with this, who to ask?

And with great disappointment, clients hear the answer from me: “Sorry, we can’t get you a certificate of lack of Ukrainian citizenship, because YOU HAVE UKRAINIAN CITIZENSHIP!” That is why in 90 percent of requests on this issue the conversation turns to the topic “What to do now?” and “How to quickly terminate Ukrainian citizenship” instead of simply obtaining the relevant certificate.

As a rule, the conversation with clients ordering this service begins as follows: “Good afternoon, I need a certificate stating that I do not have Ukrainian citizenship. I was a citizen of Ukraine until 2021, then I moved to Russia, received Russian citizenship, but my old passport expired and I did not renew it.” Or: “I was registered on the territory of Ukraine until 1994, then I left with my parents for the Russian Federation, and now, when applying for a job, they ask me for a certificate confirming the absence of foreign citizenship.”
