How to get a TIN for a citizen of Belarus

Of the states that were previously part of the USSR, it is with the Republic of Belarus that the Russian Federation has the warmest relations. In fact, Belarusians in Russia enjoy most of the rights granted to citizens of the Russian Federation. However, we should not forget about responsibilities. In modern society, one of the main responsibilities of a citizen is the timely payment of taxes. To do this, in the Russian Federation you need a taxpayer identification number (TIN). Let's find out how a Belarusian can get a tax identification number in Russia.

What is a TIN

TIN is a unique combination of symbols that allows you to identify a tax payer and facilitates tax accounting. In Russia there are 4 types of identification numbers:

  • an individual;
  • individual entrepreneur. Assigned only if the person registering the individual entrepreneur did not previously have a tax number. In another case, the individual’s TIN is used;
  • legal entity;
  • foreign legal entity.

The legal entity taxpayer identification number is a combination of 10 Arabic numerals. For foreign legal entities, the first 4 digits are always 9909. But in this article we will figure out whether a citizen of Belarus can obtain a TIN in Russia, so we will talk about the tax number of an individual.

The taxpayer identification number of an individual is a combination of 12 Arabic digits, which are distributed as follows:

  • the first 2 digits are the number of the region in which the TIN was issued;
  • the next 2 digits are the number of the tax office that assigned the TIN;
  • then 6 digits - this is the entry number in the taxpayer register;
  • the last 2 digits are control digits. They allow you to check the correctness of the TIN, but do not provide specific information.

It is important to remember that if necessary, naming a combination of numbers is not enough. You must present a certificate issued by the tax office, which indicates the last name, first name, patronymic of the taxpayer, details of this document and the TIN itself.

What is a TIN?

TIN is a special combination of symbols. It makes it possible to identify the tax payer. At the same time, standard tax accounting is significantly simplified. Today, 4 categories of such identification numbers are used in the Russian Federation:

  1. The official number of an ordinary person.
  2. IP number. It is given if the entrepreneur who registered his own business did not have a tax number. If a TIN has been received, it will be used.
  3. Legal entity number.
  4. Official number of a legal entity of another country.

Regardless of the category, the number of such a plan is a combination of 10 digits. TINs that belong to legal entities of other countries have distinctive numbers. The 10-digit number always starts with 9909.

As for the number of an individual, this is a combination consisting of 12 digits. They are distributed as follows:

  • The first two indicators are the number of the region of the Russian Federation where the document was issued;
  • The next two parameters are the tax office number that was assigned by the official TIN;
  • Next come 6 digits. This is the official entry number in a special register of tax payers;
  • The two extreme numbers have a control function. They are used to check the correct spelling of the TIN. They do not carry any specific information.

If a person is required to provide a TIN number, it is not enough to list the numbers. You will need to present a certificate that was previously issued by the tax office. This document contains information such as the full name of the tax payer, the TIN itself and paper details.

When does a Belarusian need to obtain a TIN in the Russian Federation?

On July 22, 1999, the Russian-Belarusian Treaty “On Equal Rights of Citizens” dated December 25, 1998 came into force. Article 7 of this document establishes equal rights of Belarusians and Russians to employment in Russia. Some lawyers interpret this article of the agreement as exempting Belarusians from the need to have a TIN. However, this is a misconception.

Article 83 of the Tax Code of Russia (No. 146-FZ dated July 31, 1998) establishes the need for tax registration of all taxpayers, regardless of their citizenship, at the place of residence or the location/registration of property subject to taxation.

If a citizen of Belarus comes to Russia on a visit or as a tourist, he does not need a Russian TIN. However, if in the Russian Federation he receives wages, payment for work under a contract, business profits, and so on, he must be registered with the tax service at the place where the income was received.

If a Belarusian has real estate, a vehicle or other property subject to taxation in Russia, he is also required to register as a taxpayer.

Thus, a TIN in Russia for Belarusians in 2021 is required only when they are required by law to pay taxes to the Russian Federation. Although citizens of Belarus are exempt from the mandatory acquisition of a patent. Other foreigners also need a TIN to make an advance personal income tax payment required to renew a work patent. As already noted, the registration of a tax number occurs through obtaining a certificate of registration with the tax authority. The procedure for individuals who are citizens of the Russian Federation and foreigners is the same.

The basis for obtaining a TIN for a citizen of Belarus in Russia is:

  • getting a job in the Russian Federation;
  • obtaining a temporary residence permit (TRP);
  • the presence of property subject to taxation in the Russian Federation;
  • Carrying out any transactions in Russia that are subject to taxes in accordance with current legislation.

Procedure for obtaining a TIN for Belarusians

If obtaining a TIN for citizens of Belarus working in Russia is a mandatory procedure, it would be logical to understand the nuances of obtaining the treasured certificate.

What papers need to be collected

The main document when registering a taxpayer identification number is an application - form No. 2-2-Accounting (approved by order of the Federal Tax Service of the Russian Federation on August 11, 2011 No. YAK-7-6/488). It can be filled out personally by hand or on a computer. The form is issued on site, but it can be downloaded on the website of the Federal Tax Service, as well as on our website

When filling it out, be sure to enter your exact data, without corrections or erasures. Dates are indicated in digital format, personal data must match the information in the identity document.

If a citizen has doubts about filling out certain items, you can check with the Federal Tax Service employees or use a sample for filling out the document.

The following must be attached to the completed application:

  • identity card (national passport, temporary residence permit, residence permit);
  • confirmation of registration (tear-off arrival notification coupon, migration card, residence permit stamp, etc.).

The Belarusian passport contains entries in Russian, so translation is not required, which greatly simplifies the procedure.

The list of required papers varies depending on the legal status of the Belarusian migrant in the Russian Federation.

Methods for submitting a package of documents

An application and the necessary papers to obtain a TIN can be submitted to the Federal Tax Service in several ways:

  • online;
  • using the “Legal Taxpayer” program;
  • by mail;
  • personally;
  • with the help of a trusted person.

Each case has its own nuances. The easiest way is to submit documents in person, but for this you need to set aside time and wait in line, if there is one. When sending by mail or through a proxy, copies of certificates must be certified by a notary. In order to use the “Legal Taxpayer” program, you must first install it on your computer, in addition, the citizen must have an electronic digital signature. A convenient modern option is to fill out an application online, which significantly saves time.

Where to submit documents

When submitting an application to obtain an identification number, you should contact the branch of the Federal Tax Service nearest to your place of registration. This means that the question of how a Belarusian can get a TIN in Moscow is also resolved: you need to look for metropolitan branches closest to your place of residence.

The completed certificate will be issued at the same office where the documents were submitted.

The territorial location is also taken into account when submitting an online application, because “your” tax service branch is selected from the list offered on the website. This must be remembered in all similar situations, since obtaining a TIN in St. Petersburg via the Internet for citizens of Belarus or for citizens of another country will not be difficult, as, indeed, in any city of the Russian Federation.

Terms and cost of registration

All Belarusians, of course, are interested in what the cost of a tax certificate is and how long it will take to obtain it.

The first good news: there are no financial costs in the form of a state fee for initial tax registration. Possible expenses that may be: travel, notarization of documents, payment for the services of a proxy and the power of attorney itself (if the application is submitted by a proxy).

When re-issuing a TIN certificate, you will need to pay a state fee of 300 rubles.

The second good news: it takes from 5 to 14 business days to issue a document, but usually the document is issued on the day of application.

Procedure for obtaining a TIN

To obtain a TIN, you must contact the tax office at your place of residence or location of property that is subject to taxation. The process of obtaining an identification number itself is not complicated, except that you will have to wait your turn and provide the prescribed package of documents.

Required documents

You must provide the tax office with:

  1. Application according to the established form. The form can be obtained from a branch of the Federal Tax Service (FTS) or downloaded from its official website. See what a sample of a completed application for tax registration of an individual should look like:

2. Identity document. This could be a Belarusian passport, residence permit.

3. Confirmation of registration at the place of residence or stay in Russia.

After you are registered, you will be issued a certificate of the following form:

Do I need a certified translation of documents?

If documents are submitted to government bodies of the Russian Federation in a foreign language, they should be accompanied by a translation into Russian certified by a notary. However, as can be seen from the list of required papers, the only foreign document required when obtaining a TIN is a passport. The passport of a citizen of Belarus contains a Russian-language version, so translation is not needed in this case.

Assigning a TIN to a foreigner without the participation of the person

Citizens of Belarus have the right to simplified migration registration. Persons do not require a work permit or temporary residence permit for employment, so contact with migration services occurs in rare cases. Citizens of the Republic of Belarus apply to the migration authorities to obtain a residence permit or Russian citizenship. Migration registration authorities check whether a person is registered for tax purposes.

In the absence of data on tax registration of a citizen of the Republic of Belarus, executive authorities or migration authorities are required to report to the Federal Tax Service information about the acceptance of documents from a foreigner who is not included in the database. The message is sent to the tax authorities no later than the day following the receipt of the documents (Clause 7, Article 13 of the Federal Law of July 25, 2002 No. 115-FZ). The Federal Tax Service, in turn, sends information about the registration of the person with the assignment of a number to the institution that reported the need for accounting.

The deadlines for registration are established in Order of the Ministry of Finance of the Russian Federation dated October 21, 2010 No. 129n.

Condition for registrationDuration of the operation
Registration at the place of residence or stayWithin 5 working days from the date of receipt of the notification
Issuing a TIN certificate or sending a notification to a foreigner by registered mailIn the same period – within 5 working days
Date of registrationDay of registration at the place of stay or residence

Features of issuing a TIN in the presence of a temporary residence permit

Border control is carried out at the external borders of the Customs Union, therefore, when crossing the Russian-Belarusian border, migration cards are not filled out. For most foreigners, this document is proof of legal entry and stay in the Russian Federation. Since citizens of Belarus do not fill out such cards legally, it is impossible to prove that they are in the Russian Federation beyond the established time. Thus, the period of stay of a Belarusian in the Russian Federation is not limited.

As already noted, if a citizen of Belarus does not have income in the Russian Federation, he does not need a TIN. When deciding to apply for a residence permit (usually this is a step towards obtaining citizenship), you will also need a taxpayer identification number.

Frequently asked questions

To make the procedure for obtaining your own TIN more clear, you need to study the answers to the most common questions. Here are some examples of ambiguities and explanations for them.

Question 1. Does the TIN change in the process of changing Belarusian citizenship to Russian?

No. The TIN remains the same. If a child came to Russia with his parents, he may also need a TIN. The reason is that in the process of living he can become the owner of certain property. Until the age of 18, taxes will be paid for him by his parents or legal guardians, and then this responsibility will transfer to an adult.

Question 2. Should the head of an organization issue a TIN for an employee?

The procedure for obtaining a TIN for an employee is considered mandatory. But this should not be done by the employer, but by the employee. He must obtain a TIN on his own. This can be done on the Federal Tax Service portal or on the public service resource.

How to find out if you have a Russian TIN

You can find out if you have a Russian taxpayer identification number:

  1. At the territorial inspection of the Federal Tax Service - in this case, you must provide a document confirming your identity.
  2. Through the multifunctional center (MFC). MFCs accept applications and documents for other government agencies - in our case, the papers are sent to the Federal Tax Service, then the response to the request comes to the MFC. Due to the forwarding of documents, it may take longer to receive a response. But there are practically no queues at the MFC.
  3. Via the Internet - in this case, information can be found:
      on the Federal Tax Service website - this is the fastest and easiest way. Go to the website via the link https://service.nalog.ru/inn.do, fill out the required information, enter the captcha and activate the “Send request” button.

If you were assigned a TIN, it will appear in the response line. You do not need to register on the website to receive this service;

  • on the State Services portal - you need to go to the resource at the link https://www.gosuslugi.ru/16816/2. The further procedure is the same as on the Federal Tax Service website. To work with State Services, you need a personal account. Registration will take several days, but in the future this time investment will be worth it.

There are also many unofficial sites that offer the service of providing the necessary information. However, we do not recommend using them: there are many scammers on the Internet who collect personal data.

How to check availability of TIN?

You can find out whether or not an individual tax number has been assigned in different ways:

  1. Visit to the territorial inspection of the Federal Tax Service. In such a situation, you will need to provide a document that confirms the person’s identity.
  2. Through MFC. In this organization, employees accept applications and official documents for other government agencies. In the case of a TIN, the papers are sent to the Federal Tax Service. After a certain time, the MFC receives a response. Despite the fact that there are no queues in this organization, verification may take some time. This is the period for sending documents.
  3. On the official website of the Federal Tax Service. This is the fastest way to check your own number. You need to go to the portal, fill out your personal information, enter the security captcha and click on the submit request button. Registration is not required here. If there is a TIN, it will automatically appear in a special line.
  4. On the public service portal. You need to go to this site and perform the same actions as on the Federal Tax Service portal. The difference is the need for pre-registration and access to a personal account.

Despite the fact that verification through State Services is considered the most time-consuming method, you should not neglect registering with it. Creating a personal account takes several days. But these expenses will be justified, since the portal opens up many opportunities for users and significant time savings in the future.

There are many other portals that offer verification, but not everyone should be trusted. The reason is that the majority of such portals are scammers. They collect personal data and use it for their own purposes.
