Disabled people are among the most vulnerable citizens. It so happened that even the difference in age does not affect the situation in any way. A person becomes completely dependent on the help of third parties, as a result of which he receives support from the state in the form of social benefits. More than 8% of people with disabilities live in the country, and this percentage is increasing every year.
Indexation of pensions for disabled people in 2019
Information was released on the projected increase in benefits in 2021, in accordance with inflation. According to some data, this coefficient will amount to an additional payment of 3.5-4%. A more accurate amount will be established after the planned recalculation on May 1, 2019. Members of the government voiced the following reasons for its implementation:
- Devaluation of the state currency.
- Inflationary growth.
Natural resources have become noticeably more expensive compared to the past period, as a result of which the state treasury has been replenished with financial resources. Based on this, the government has set a course for increasing pensions for disabled people in 2021. How much they will add will be discussed in the article.
Social pensions in 2021
Payments to vulnerable groups of the population are provided to different categories of citizens. These include people with disabilities of various groups, disabled children, as well as people with disabilities since childhood. The last category is taken into account only in case of permanent residence in the country.
Since March 2021, government members have unanimously voted for Resolution No. 247. It recalculated and indicated the exact indexation coefficient for social and insurance pensions - 4%.
If we consider this percentage in numbers, then the amount with additional payment is as follows:
- third group - 6302 rubles;
- second and children of war - 7561 rubles;
- first and group 2 disabled children - 12,595 rubles;
- disabled children of the 1st group and disabled children - 13,607 rubles.
The disability pension in 2021 can be established for a short or long term. If the latter is appointed, the availability of work experience is checked. Then members of the government will determine how much the increase will be and when it will be raised.
Assignment of social disability pension, documents
To assign a disability pension, you must contact the territorial division of the Pension Fund of the Russian Federation - the Pension Fund of the Russian Federation:
- electronically through the Pension Fund website or the State Services portal;
- personally;
- through a representative by proxy;
- through the MFC;
- by post.
The legal representative of a disabled child can contact the Pension Fund electronically through his personal account on the fund’s website or on State Services, indicating that he is the legal representative of the minor. If you contact us in person, you can use the pre-registration service.
Documents that must be submitted to the Pension Fund office to apply for a disability pension:
- application for a social pension;
- identity card: passport of a citizen of the Russian Federation, residence permit of a foreign citizen or stateless person;
- child’s birth certificate, if a pension is assigned to a disabled child;
- identification card of the representative and documents confirming his authority;
- other documents necessary to confirm additional circumstances;
- an extract from the act of the federal institution of medical and social examination on the establishment of disability.
Increase in monthly allowance for disabled people in 2021
In 2021, almost 16 million people who are beneficiaries receive cash payments every month in the Russian Federation. To issue an EDV in accordance with the law, you must present the following documents:
- passport;
- certificate confirming the availability of pension insurance;
- all necessary ITU certificates.
From April 2021, the EDV will be calculated in accordance with the standards of Federal Law No. 181 plus 5.5% indexation. In addition, its final size directly depends on the disability group. The assigned amounts of EDV are paid only in case of complete refusal from the set of social services (NSS), the cost of which is 930 rubles.
Pension for parents of disabled children in 2019
If there is a disabled child in the family, both the mother and the father can receive a separate benefit. Also taken into account are people who have the status of official guardians. To become more familiar with who the guardians of disabled children can be, you can take a closer look at Article No. 35 of the civil legislation. Only authorized bodies are required to make appointments.
People who have previously had problems with a criminal record or have been deprived of parental rights cannot be guardians.
Features of the pension:
- Financial support is provided together with the social pension.
- An applicant who requests payment of benefits must submit all documents confirming the child's disability and need for care.
- Assistance is awarded only to those citizens who are unable to earn money on their own due to constant care for a disabled person.
This benefit is not subject to annual indexation; its amount is 1,200 rubles.
Parents or official guardians of a disabled child can receive not only pension or social benefits, but also certain benefits for paying taxes and housing.
People who are raising children with disabilities are allowed by law to reduce their retirement age. To do this, a number of conditions must be met. There are also additional amounts of pension points, benefits and service packages that will also add.
Pension for disabled children from January 1, 2021: how much will be added
In 2021, there were no significant changes in the situation of families with sick children. Parents or guardians received pensions in the amount of 60% of the minimum wage. At the same time, they provide a report on the funds spent. Money should only be spent on the maintenance of children with disabilities.
For disabled people of group 1, the pension is currently 8,647 rubles, group 2 – 4,323 rubles, group 3 – 3,675 rubles. In the regions of the country, assistance programs for families with disabled children have been additionally developed and began to function.
Since these families have increased utility costs due to the additional expense of caring for a sick child, they are provided with a 50% discount on all housing expenses, including telephone fees.
There will be some changes for the better in 2021. From January 1, 2021, the minimum wage will increase in all regions of Russia, therefore, pensions for disabled children will automatically increase.
Specific numbers may vary in different regions of Russia. The necessary information can be obtained from the social protection service at the family’s place of residence.
Pension for a disabled child in 2019
List of due payments:
- Social pension, which belongs to one of the categories of government benefits of this type. All information directly related to it is set out in detail in Law No. 166. Based on its provisions, only those individuals who have officially confirmed their disability status receive a social pension. To really begin to receive such support from the state, you must reside permanently on the territory of the state.
- Monthly cash payments (MCP). Disabled children have every right to receive regular payments from the state, the amount of which is 2,400 rubles. It also includes a set of social services in the amount of 995 rubles. The child can choose how he wants to receive support - in cash or in the form of in-kind assistance. If you choose the second one, the total amount will be 1405 rubles.
Law No. 178 of July 17, 1999, which lays out all the points of social assistance, also states that all disabled children have the full right to a certain list of social services.
Such accrual is carried out only from the state side.
As additional services, people with disabilities and pensioners will be provided with free medications, specific products for treatment and, if necessary, rehabilitation. In addition, the child receives the right to stay in the sanatorium for free for 21 days, travel is also included. The same is allowed for the individual who accompanies the disabled person - mother, father or public guardian.
Parents of disabled children also receive some privileges. If one of them has physical limitations of any type, he has the right to retire from the age of 50. However, for this it is important to comply with certain conditions: the child at that time must be no more than 8 years old. Also, the total experience of parents for two must be 15 years. Article No. 91 provides another advantage - if a woman is caring for a disabled person, she has the right to part-time work. Only in this case the child’s age should not exceed 18 years.
Remuneration is carried out in accordance with the total hours worked.
Benefits for parents of disabled children
Families raising disabled children have the right not only to receive benefits and payments, assistance is also provided in the form of benefits. Such support measures make it easier to care for a child and meet basic needs. Benefits for disabled children are assigned without taking into account need ; in order to design them, it is not necessary to confirm the income and status of a low-income family.
Tax deduction for a disabled child
A personal income tax benefit is provided for every disabled child under the age of 18 , and if he is studying full-time, is a graduate student, resident or intern, then up to 24 years . The benefit is given to both parents (adoptive parents, guardians) of the child if they are employed. The purpose of the deduction is to supplement the parent's tax-free salary.
According to Art. 218 of the Tax Code of the Russian Federation, the amount of the deduction depends on who is taking care of the child:
- if it is a parent or adoptive parent - 12,000 rubles ;
- guardian or adoptive parent - 6,000 rubles .
The benefit can only be received by those citizens whose salary is less than 350 thousand rubles per month. Starting from the month when a person’s income exceeded the designated amount, the tax deduction no longer applies.
To design a deduction, you need to contact your place of work. The benefit will be provided until the end of the year in which the recipient’s right to it ends.
Alimony after 18 years for disabled children
According to Art. 85 of the RF IC, ancestors must support their own adult children if they are not able to work . This category of people also includes disabled people of groups I, II or III.
Alimony is due to persons with disabilities after 18 years of age if:
- the recipient was declared disabled ;
- needs parental care;
- not officially .
If the parents of a disabled child are divorced, financial support will be assigned in the form of monthly alimony in the amount of:
- established by agreement of the parties (random amount);
- established by a court decision if the parties cannot agree. When assigning the amount, the financial situation of both parties is taken into account.
Labor benefits
The Labor Code of the Russian Federation provides a number of benefits for parents raising disabled children. They operate throughout the Russian Federation all employers must provide benefits, regardless of the charter of the enterprise and form of ownership.
One of the parents (guardians, trustees) has the right to:
- 4 days off every month , paid in the amount of average earnings (Article 262 of the Labor Code of the Russian Federation);
- receiving annual paid leave at a time convenient for the employee (Article 262.1 of the Labor Code of the Russian Federation).
Also, employees raising disabled children are provided with the following guarantees :
- Sending on business trips, recruiting to work overtime, as well as to work on weekends and non-working holidays is prohibited without the written consent of the employee (Article 259 of the Labor Code of the Russian Federation).
- An employment contract cannot be terminated at the initiative of the employer, including when staffing or the number of employees is reduced (Article 261 of the Labor Code of the Russian Federation).
- At the request of such an employee, the employer must introduce for him a part-time working day or a part-time working week (Article 93 of the Labor Code of the Russian Federation).
One of the parents who raised a disabled child until the age of eight has the right to early registration of an old-age insurance pension . You can apply for a destiny at the following ages:
- 55 years old - for fathers with 20 years of insurance experience .
- 50 years old - mothers with 15 years of work experience .
Pensions in 2021 for disabled children
Starting from April 2021, the amount of pensions has undergone a noticeable increase compared to previous years. Disabled people of group 1 and 2 from birth, as well as children of war, received an increase in the total amount of material support in the amount of 412 rubles. The second group – 206 rubles, and the third – 175 rubles. People with obvious disabilities since childhood will receive an additional 495 rubles.
In addition, disabled people are accrued a monthly cash payment (MCA), the amount of which is determined individually depending on the group. Indexation for this assistance is carried out regularly, so it will be raised accordingly.
Even taking into account all the existing problems and difficulties, the government is trying to create the most comfortable conditions for citizens with disabilities. In this case, there are certain benefits:
- 50% discount on all medicines in state pharmacies.
- Travel on public transport is paid at a reduced rate - half the established amount.
- Visiting sanatoriums for treatment or prevention.
- Special conditions for disabled people who want to study at universities await admission without competition.
- The opportunity to gain knowledge to master a new necessary profession through special courses.
All forecasts of when pensions will be increased and what amount will be added are indicated taking into account possible risks and changes. After their consideration, increases will be observed from January 2021. People with disabilities are completely dependent on the state, so attention to benefit payments is always at the forefront.
