A civil servant is an employee who performs functions in accordance with his position, is employed in the public service and receives wages from the country’s budget. The category has both administrative and control functions.

Features of pensions for civil servants

Civil servants have the right to receive 2 pensions at the same time:

Now only those who have worked not 15 years, but 20 years (increasing gradually) can receive the first pension.

The retirement age for them has also increased: for men it is now 65 years, and for women 63 years.

To receive the first type of pension, several conditions must be met:

• reaching above the stated age;
• continuous work experience of at least one year before retirement;
• dismissal only by agreement between the parties, for example, when changing the terms of the contract, liquidation or layoff.

A person can receive a pension at an earlier age, but then the work experience in the civil service must be at least 25 years, and a continuous period of 7 years. In the event of liquidation of a state body or reduction, it is possible to obtain security without working for a year.

Government officials have the right to count on insurance coverage after 15 years of employment, which includes length of service in the public service. It is paid only if you have the required number of points and reach the age limit.

The insurance payments include the following periods:

• all activities during which contributions to compulsory pension insurance were paid;
• civil service period;
• other terms specified in Article 12 of the Federal Law “On Insurance Pensions”.

The insurance payment is made based on the number of pension points, which are multiplied by the cost of one IPC. Government officials receive the amount without a fixed rate.

If a person continues to work after receiving support, then he is entitled to a recalculation, since he continues to pay contributions to the Russian Pension Fund.

In this case, the share of insurance coverage is subject to recalculation based on the points received, which were not previously taken into account when calculating the payment. Recalculation is carried out automatically annually in August without submitting a corresponding application.

Legislation on the procedure for indexing pensions of civil servants

The procedure for indexing pensions of civil servants is regulated by:

• Article 25 “The procedure for indexing pensions” of the Federal Law of December 15, 2001 No. 166-FZ “On State Pension Provision in the Russian Federation” (as amended on December 27, 2018) and
• Decree of the Government of the Russian Federation of May 31, 2005 No. 346 “On indexation of pensions of federal civil servants” (as amended on August 4, 2015).

Changes in pension legislation under the 2019 Pension Reform also affected civil servants. For them, the retirement age has already been raised from January 1, 2021 to 63 and 65 years old annually in six-month increments.

According to the new Federal Law “On Amendments to Certain Legislative Acts of the Russian Federation on the Appointment and Payment of Pensions” dated October 3, 2018 No. 350-FZ:

• The retirement age for civil servants will increase from 01/01/2020 at the same pace as for other citizens receiving an old-age insurance pension - by 1 year annually .

The procedure for indexing pensions paid under Federal Law No. 166-FZ “On State Pension Provision in the Russian Federation”

Indexation of pensions of federal civil servants is carried out:

• with a centralized increase in salary (monetary remuneration) of federal civil servants
• taking into account the provisions provided for in Article 14 “Amounts of pensions of federal civil servants” and Article 21 “Average monthly earnings from which the amount of pensions of federal civil servants is calculated” of Federal Law No. 166-FZ “On State Pension Security in the Russian Federation”,
• in the manner established by the Rules for Indexation of Pensions of Federal State Civil Servants, approved by Decree of the Government of the Russian Federation of May 31, 2005 No. 346.

Clause 1 of Article 25 “The procedure for indexing pensions” of Federal Law No. 166-FZ “On state pension provision in the Russian Federation”

Indexation of pensions of military personnel and members of their families (with the exception of pensions of military personnel who served in conscription and members of their families) is carried out:

Rules for indexing pensions of civil servants

Rules for indexation of pensions for civil servants, approved by Decree of the Government of the Russian Federation of May 31, 2005 No. 346:

Indexation of civil servants' pensions is carried out:

• by indexing the average monthly earnings of a civil servant, from which his pension was calculated, to the corresponding indices indicated above (with the sequential application of all previous indices), and
• subsequent determination of the size of a civil servant's pension based on the amount of indexed average monthly earnings.

When indexing civil servants' pensions using the salary increase index or the weighted average salary increase index:

• the amount of indexed average monthly earnings, from which the size of the civil servant’s pension is determined,
• cannot exceed 2.8 of the official salary (0.8 of monetary remuneration) applied when calculating the amount of the pension and indexed using the specified indices for increasing official salaries, with the sequential application of all previous indices for increasing official salaries.

When indexing civil servants' pensions using a weighted average index for increasing one or more cash payments:

• included in accordance with the legislation of the Russian Federation as part of the salary of federal government civil servants,
• the amount of indexed average monthly earnings, from which the size of the civil servant’s pension is determined,
• cannot exceed 2.8 times the official salary applied when calculating the amount of a civil servant’s pension as of the day from which indexation is made on this basis.

For civil servants living in the Far North and equivalent areas, in areas with severe climatic conditions, where additional material and physiological costs are required:

• the amounts of pensions indexed in accordance with the above Rules,
• are increased in the prescribed manner by the corresponding regional coefficient for the entire period of residence of civil servants in the specified areas (localities).

Terms of indexation of civil servants' pensions

Indexation of civil servants' pensions is carried out:

• from the date of centralized increase in salary (monetary remuneration) of civil servants.

PENSION REFORM 2021: INCREASING THE PENSION AGE

Indexation and recalculation of pensions for civil servants in 2021

Currently, the pension is calculated at the rate of 45% of average earnings if the person meets the criteria. For overtime in 3 years, another 3% of wages is added.

Recalculation example

Based on length of service, the calculation is as follows. For example, state support for length of service for citizen P.P. Ivanov. assigned in the amount of 25,000 rubles. He worked the required period of time to receive a pension.

The recalculation of the pension in this case will look like this: 25,000 * 0.45 = 11,250 rubles.

Then he continued his activities to increase his income. He worked for another year. We get the following formula: 25,000*0.45+3%*25,000*1 year = 12,000 rubles. The procedure for forming a pension

To assign pension payments based on length of service, a civil servant must prepare the following documents in advance (6 months before retirement):

• Statement.
• Passport details.
• Employment history.
• Military ID.
• Salary document for the last year of work activity.
• A certificate indicating the period of work and the name of the position in the government agency.
• Order of dismissal (copy).
• A certificate confirming the availability of pension payments for old age or for other reasons (or refusal of relevant payments).

The citizen (or through the principal) transfers the entire list to the personnel department, where the following actions are performed:

• checking the completed application;
• reconciliation of original documentation with copies;
• registration of the application and issuance of a receipt indicating the date of receipt of the document;
• issuing certificates about the average salary;
• preparation of documentation on the name of the position, period of work in government agencies;
• preparing a submission on the assignment of payments to the Pension Fund;
• sending documents to the fund. The deadline for submitting documentation is 1 month after receipt.

The period for reviewing documents in the fund is 10 working days. If all documentation is available, payments are made from the beginning of the next month.
