The concept of maternity capital

The maternal or, as it is also called, family capital program is a form of government support for families with children. Such funds can be disposed of in strictly prescribed areas, among which are:

• improvement of living conditions;
• tuition fees;
• formation of a funded pension for the mother;
• social adaptation and integration into society of disabled children.

The legislative framework

The maternity capital program was put into effect by Federal Law No. 256-FZ of December 29, 2006 “On additional measures of state support for families with children.” Since that time, several changes have been made to the legal act.

The conditions and procedure for using funds for certain purposes are regulated by separate by-laws. For example, issues related to education are regulated by Decree of the Government of the Russian Federation dated December 24, 207 No. 926 “On approval of the Rules for allocating funds (part of funds) of maternity capital for the education of a child (children) and other expenses related to the education of a child (children)."

Certain aspects of this issue are regulated by orders of relevant ministries in the field of social protection of the population: on approval of rules for filing an application, maintaining a register of persons entitled to state support, and so on.

Maternity capital is an important form of state support for Russian families raising children, and is a great help for obtaining educational services. Parents of students of the University named after O.E. Kutafina (MSLA) can use maternity capital to fully or partially pay for educational services.

Article 7 of the Federal Law “On additional measures of state support for families with children” dated December 29, 2006 No. 256-FZ states that maternity capital can be spent on a child’s education. This provision applies to paid educational services in educational programs that have state accreditation (for example, university studies).

There are important conditions: for example, on the start date of study, the student must be no older than 25 years. Another significant aspect is that the university must be located on the territory of Russia and have the right to provide relevant educational services.

Maternity capital can be used for higher education of any of the children when the second, third child or subsequent children turn three years old. An exception is preschool education - in this area, maternity capital can be disposed of immediately after the birth of a child, which gives the right to a certificate.

To pay for tuition at the expense of maternity capital at Moscow State Law Academy, it is necessary to conclude an agreement on the provision of educational services (usually with the mother, since she is the recipient of the certificate), as well as enter into an additional agreement to the main agreement (it specifies the details and information about that payment comes from maternal capital funds).

Some families use maternity capital partially, some in full. In addition, you will need a copy of the university license to submit documents to the Pension Fund of the Russian Federation. You must apply to the Pension Fund of the Russian Federation regardless of your place of residence (stay) or actual residence in person, through your personal account or through the MFC.

What documents will need to be submitted to the Russian Pension Fund?

— a written statement from the owner of the certificate about the disposal of funds (part of the funds) of maternity capital. The application form is issued by the territorial body of the Russian Pension Fund;

— documents proving the identity of the person who received the certificate;

- if the application for disposal is submitted through a representative of the person who received the certificate: documents identifying the identity and powers of the representative;

— a copy of the agreement on the provision of paid educational services certified by the university (additional agreement, as well as copies of the license of the educational organization to carry out educational activities).

In addition to paying for studies, maternity capital funds can also pay for a student’s accommodation in a dormitory. The payment procedure is similar to that indicated above.

Possibility to pay for the education of an older child

The great advantage of this program is that its funds can be used to educate any of the children. Thus, it is allowed to use maternity capital for the education of the older child. The convenient thing is that you can spend the money in parts, so half of the help can be directed to the education of the older child, and the rest to the kindergarten of the younger one or other purposes.

You can pay tuition fees to any educational organization in accordance with the requirements established by law. Funds can also be used for related services, for example, for student accommodation in a dormitory.

Until 01/01/20, maternity capital for the education of the first child could be used subject to the following conditions:

• educational institution on the territory of the Russian Federation;
• the child is under 25 years of age at the time of training;
• the youngest child has reached the age of three.

From 01.01.20, for the first child, this type of state assistance will be available in the basic amount. In 2020 it is 466,617 rubles. For the second or subsequent one, an additional 150 thousand rubles will be paid.

What forms of education can maternity capital be spent on?

As already noted, fees can be paid to educational institutions of various levels, including for secondary vocational education at a technical school or college.

If a child attends an institute or university, you can also pay for higher education. A university can be public or private, but must meet the requirements established by law and have:

• license to provide educational services;
• certificate of state accreditation.

In addition, all educational programs must meet state standards.

Another question that interests many parents is whether it is possible to pay for master’s or graduate school. In fact, there is nothing stopping you from spending money on such training. However, certain circumstances may become an obstacle to this. For example, at the time of using the funds, the student may be over 25 years old, especially if we are talking about graduate school. Therefore, in this case, the age limit should be taken into account.

Thanks to the program, distance learning at a university is also possible at the expense of maternal capital. The same goes for evening uniforms. However, not all programs provide for such types of payment, which significantly reduces the use of the certificate in this area.

List of documents

To exercise your right to receive state assistance for your children’s education, you must contact the Russian Pension Fund at your place of registration or place of actual residence. At the same time, many people have a logical question about what documents are needed for this. You can serve them in several ways at your discretion:

• by personal appeal to the Pension Fund authorities;
• through the Multifunctional Center;
• by mail;
• electronic.

Based on the chosen direction, a list of required papers is determined. However, we can highlight a general list of documents for paying for education with maternity capital:

• documents identifying the owner of the certificate, as well as confirming the place of registration;
• maternity capital certificate;
• a copy of the agreement concluded with the educational organization;
• insurance pension certificate of the applicant.

In cases where documents are submitted through a representative, a notarized power of attorney must be attached. In addition, you must write an application indicating the following information:

• name of the PF body;
• applicant's passport details: full name, date and place of birth, gender;
• Bank details;
• information about the child/children;
• contact details: address, telephone;
• date and signature.

All information is entered into a special form. There are no deadlines for submitting an application.

The procedure for allocating capital for training

How to pay for studies with maternity capital? The mechanism of action in this case is as follows:

• Select an educational institution.
• Conclude an agreement for the provision of services.
• Collect a package of documents for the Pension Fund.
• Submit documents.
• Wait for a decision.
• Make a payment.

It is important to consider that maternity capital can be used for a child’s education only after the second child reaches the age of three.

An exception is payment for the services of a private kindergarten for a child. Then you can exercise your right to a certificate at any time.

The contract for the provision of services concluded between the certificate holder and the educational organization must contain the following information:

• information about the organization - organizational and legal form, place of registration and location, information about the license, line of activity, TIN, OGRN, etc.;
• information about the certificate holder - full name, passport details, registration and residence address;
• information about the student - full name, passport data or information from the birth certificate, registration and residence address;
• cost of education;
• list of paid services;
• training period;
• the procedure for transferring payments;
• bank account details for transferring money;
• signatures of the parties;
• organization seal;
• date of conclusion.

When sending maternity capital for training, the following documents are needed:

The application contains the following information:

• FULL NAME. the applicant;
• Date of Birth;
• SNILS;
• certificate details: series, number, by whom and when issued;
• passport details: series, number, by whom and when issued;
• residence and registration address;
• goal: obtaining an education for the child and paying related expenses;
• sum;
• confirmation that there was no deprivation of parental rights, crimes against the child, or cancellation of adoption;
• confirmation of familiarization and rules for sending and using the certificate;
• list of applications;
• date of;
• signature, transcript.

It is necessary to keep in mind that money can be sent either through one or several training agreements at once. It is allowed to use both the entire amount of capital and its part.

Authorized employees of the Pension Fund of the Russian Federation are considering the case. This takes up to 30 days.

If a positive decision is made, the money begins to be transferred within 10 days to the account of the educational organization in the manner specified in the agreement: one-time, monthly, with established frequency.

The pension fund is obliged to independently follow the procedure for paying for education with maternity capital and to prevent the formation of debt.

In this case, no additional actions are required on the part of the certificate owner.
