Obtaining Chinese citizenship: questions and answers

Legal basis

The settlement of the issue regarding acquisition in China is carried out on the basis of the following current legislative acts of Russia and China:

  • Regulatory legal acts of the PRC on citizenship and legal status of Chinese citizens;
  • laws of the PRC on migration registration of foreigners and stateless persons;
  • Federal Law of the Russian Federation No. 62 of May 31, 2002 “On Citizenship of the Russian Federation”;
  • Federal Law of the Russian Federation No. 143 of November 15, 1997 “On acts of civil status”;
  • etc.

Under these laws, compatriots can apply to China's Ministry of Security and Public Affairs for citizenship.

Methods

There are five different options for obtaining citizenship:

  1. By right of birth in the territory of the People's Republic of China.
  2. Through naturalization.
  3. Through marriage to a Chinese citizen.
  4. By investing in the development of the economy and enterprises of the state.
  5. Finish university and get a job.

In the last 2 methods, the country can reduce the period for consideration of the application. Otherwise, the candidate has the right to apply for citizenship only 10 years after staying in the PRC.

  • By birth

A child born on the territory of the PRC automatically becomes a Chinese citizen, but this opportunity applies only to the local population.

In a family where both parents are foreigners, you may not think about citizenship for your minor child, due to strict laws and relocation of the state.

In those families where at least one of the parents has Chinese citizenship, the child is granted Chinese citizenship.

If both parents do not have citizenship, and on the date of birth of the child he is in “Stateless” status, the government of the country gives the child a Chinese passport. After which, after a certain period, his mother and father also have the right to obtain Chinese citizenship.

  • Upon marriage

Having formalized an official marriage relationship with a representative of China, you, as a foreign person, can apply for a residence permit, as well as permanent residence.

To obtain official citizenship you need to wait the same ten years, then you can start applying for Chinese citizenship.

Moreover, after the expiration of the period of continuous stay in the PRC, it does not matter whether the newlyweds are married or not; citizenship will be obtained in any case.

  • Naturalization

Most foreigners planning to move to China for permanent residence enter this state with only a work or study visa. Only after some time will they be granted a residence permit in China.

If the applicant has any benefits, the process goes faster. However, in the absence of relatives from China or sufficient money to start a business, a subject from another state has the right to count on a passport from the Celestial Empire only on a general basis.

The length of stay on a residence permit or a work (or study) visa is of great importance for naturalization. The longer a citizen has lived in China, the greater the chance that the application for a Chinese passport will be resolved successfully.

As a rule, to do this you need to live in the country for more than 5 years without violating any laws and having claims from the tax service and law enforcement agencies.

Requirements for a candidate

The procedure for obtaining Chinese citizenship is complex and bureaucratically complex. However, there are no guarantees of a positive result. Each province may have its own process.

But in general, the following requirements are imposed on candidates:

  • residence in China must be legal;
  • an additional advantage will be the presence of close relatives in the country (children, spouses, relatives among the Chinese);
  • a stable and legal source of income, sufficient to provide not only for yourself, but also for your family;
  • compliance with the legislation of the People's Republic of China, in particular the fulfillment of tax obligations;
  • good mental and physical health;
  • absence of fact of criminal prosecution;
  • knowledge of Chinese;
  • willingness to renounce other citizenship.

How to obtain Chinese citizenship procedure and deadlines

There is an opinion that you can become a citizen of the People's Republic of China by purchasing real estate in China. It is a myth. Obtaining citizenship requires serious legal and personal reasons; purchasing real estate is not one of them.

Where to contact

This is a government body that performs the same functions in China as the Ministry of Internal Affairs in other countries. A positive or negative response will be provided within 15 days. If rejected, you must be given a clear explanation of the reason for rejecting the application. According to the Entry/Exit Law of the People's Republic of China, you may be refused primarily for the following reasons:

  • deliberately false information in the application;
  • absence of at least one required document;
  • violation of the law while living in the PRC, incompatible with further residence in the country;
  • inappropriate visa category;
  • other reasons why public security authorities reserve the right to refuse citizenship.

Article 7 of the Citizenship Law

If the answer is positive, you can obtain a ready-made passport at consular offices and other foreign missions of the PRC, as well as at the external relations bodies of the people's governments of provinces, autonomous regions and cities. Information about the passport holder in the document is duplicated in Chinese and English.

Every new Chinese citizen must swear allegiance to the country and its laws.

Is translation of documents necessary?

Yes, to apply for Chinese citizenship, documents must be translated and also legalized. The legalization procedure for using them in China is a little more complicated than in other countries. The fact is that China is not a party to the Hague Convention (the only exceptions are Hong Kong and Macau), therefore the apostille procedure - simplified legalization of documents - is impossible. The procedure for re-issuing documents takes place exclusively through consular legalization.

A consistent action plan for the legalization of documents for their further use in China:

  1. Notarization of documents and translation (if required).
  2. Certification of a notary's signature at the Ministry of Justice of the Russian Federation.
  3. Certification of the seal of the Ministry of Justice in the Consular Department of the Ministry of Foreign Affairs of the Russian Federation.
  4. Legalization of documents at the consulate of the country in which they are intended to be used, that is, in China.

  • a certificate from the fiscal services with information about the amount of tax revenue received from the foreigner during his stay in the PRC;
  • honey. a certificate certifying that you are not sick with dangerous or infectious diseases;
  • diploma of education;
  • photocopy of the employment contract (for hired workers).

Deadlines

As soon as you have submitted papers to acquire citizenship of a country like China, the verification and registration of a new representative of the “Celestial Empire” begins.

If there are no complaints about the list of documents, consideration of the submitted petition may take a couple of months to six months.

After which the application is returned again to the Ministry of Foreign Affairs of the People's Republic of China, to the department of the migration service, from this government agency the applicant for citizenship receives a response about the provision of a passport or refusal to do so.

If the application is approved, you will already receive the status of a Chinese citizen; all that remains is to purchase a Chinese passport.

Types of passport

The following types of documents are issued in China:

  • standard identification card;
  • diplomatic passport;
  • Hong Kong and Macau passports.

There are both positive and negative aspects to Chinese citizenship. The benefits include:

Employment occurs quickly and without problems.There are many vacancies in China for anyone who has studied Chinese. The recovery procedure is as follows. According to Article 13 of China's Nationality Law, foreign entities who previously had Chinese citizenship, but have lost it, have the right to apply for the restoration of a country's passport if there are grounds for this. But in a situation where the appeal is granted, the person is automatically deprived of his previous citizenship.

Have you been refused? Common mistakes

  • provision of knowingly false information in documentation;
  • lack of necessary papers;
  • offenses that are incompatible with subsequent residence in China;
  • refusal to obtain a residence permit or permanent residence.

The disadvantages of a Chinese passport include:

Problem with obtaining a visa to other countries.China actually does not have an agreement with other countries on visa-free entry. The environment of the People's Republic of China is in a deplorable state.The polluted air of the metropolis harms the health of the population.

Example

I am a citizen of the Russian Federation, I want to move to China with my wife and child for permanent residence. Is it possible to have dual citizenship?

“Despite the fact that in the Russian Federation the provision of a passport of another country, this provision is in conflict with the laws of China. Dual citizenship is prohibited in China.

Accordingly, if law enforcement agencies have information that a resident of the “Celestial Empire” has a passport of another country issued in his name, this may lead a Chinese citizen to invalidate his second citizenship,” answers migration law lawyer N.A. Vasilyev, web specialist. website 9111.ru.

Despite the multi-stage and long process of obtaining Chinese citizenship, it is possible to obtain a passport of the country. To do this, a foreign person must have a good knowledge of the Chinese language and know the laws of this state.

China is one of the most developed countries in the field of economy, light industry, electronic technology, etc. It is no coincidence that recently an increasing number of residents of Russia and the CIS countries want to move to the Celestial Empire for permanent residence.

But obtaining Chinese citizenship today is not easy, and sometimes almost impossible, since China is not a country that pursues an active policy of attracting immigrants. For a number of reasons, the state’s migration policy is quite conservative - the legislative framework was approved back in 1980 and has remained almost unchanged to this day.

Necessary conditions for obtaining Chinese citizenship

Not every foreigner can become a full-fledged resident of the Celestial Empire - to do this, citizens of other countries must meet a number of requirements set out in the “Law of the People's Republic of China on Citizenship.”

In particular, according to Article 7, a foreigner can obtain Chinese citizenship if he permanently resides in the territory of the PRC, does not have serious health problems, as well as criminal records and offenses both in China and in his homeland. In addition, an applicant for citizenship must know the Chinese language, respect the country's constitution, accept the ideology of the state and not pose a threat.

Answering the question of how to become a Chinese citizen, it should be noted that to do this you need to belong to one of seven categories:

  1. Direct and stable investments in China for 3 years in the amount of 500 thousand to 2 million USD.
  2. Work in a Chinese company as a senior manager (4 years of experience).
  3. Having special services to the country.
  4. Marriage with a Chinese citizen or a foreigner who has a permanent residence permit in the country for 5 years.
  5. Residence in the country of immediate relatives (brothers and sisters, spouse, parents of natural or step-parents, minor children, both natural and adopted).
  6. Disabled relatives who have reached retirement age (over 60 years old), are dependent on a Chinese citizen or a foreigner who has a residence permit in China and have been permanently residing in the country for more than 5 years.
  7. Minor children of a Chinese citizen or a foreigner who has a residence permit in China.

You can also obtain citizenship of China or the PRC if you do not fall into any of the above categories, but you have other compelling arguments - for example, you are a friend of the Chinese people, make a significant contribution to the prosperity and development of the country, etc. d.

Documents for obtaining permanent residence in China

To obtain a passport of a citizen of the People's Republic of China, you must prepare the following documents:

  1. Foreign passport and its photocopy.
  2. An application drawn up on a special form.
  3. A document confirming the absence of a criminal record - this paper must be certified by the Chinese consulate.
  4. A paper confirming the existence of grounds for obtaining a Chinese passport.
  5. A document indicating the absence of health problems.
  6. Photos.

When preparing documents, you may be asked to provide additional documents. Their list will depend on the immigration program. Documents must be translated into Chinese and notarized. It is better to make a translation in a specialized agency that has the appropriate license.

Citizenship Process

Before obtaining Chinese citizenship, you must live in the country permanently for 5 to 10 years. When considering an application, a reference from the place of work is of great importance, confirming, among other things, the candidate’s ability to join the workforce.

To obtain citizenship, you must know Chinese, because... it is the only official language in this country. It can be studied in specialized courses while still in your own country, or in free government courses upon arrival in China.

Speaking about how to obtain citizenship in China for a Russian citizen, first of all you need to do the following:

  1. Find out which clause of the “Law of the People's Republic of China on Citizenship” allows you to apply for citizenship of this country.
  2. Visit the embassy and the special bureau for public safety in the PRC. From these organizations you can take an application for citizenship, which you need to fill out.
  3. Collect all the necessary documents that should be submitted to specially authorized organizations involved in issuing a Chinese passport.

The application and documents are reviewed by the Chinese Ministry of Security. After a thorough check, this organization will make a decision, and the result can be either positive or negative. If a positive decision is made, you will be issued a certificate that allows you to obtain Chinese citizenship. This is a Chinese passport.

Features of Chinese citizenship for children

A child (regardless of his nationality) automatically becomes a citizen of the People's Republic of China if he was born in any of its provinces, but only if at least one of his parents has Chinese citizenship. In addition, citizenship is granted to orphans found on the territory of the PRC, as well as children of stateless persons living in the Middle Kingdom.

If a citizen of the People's Republic of China adopts a child, the latter automatically receives citizenship.

In China, adults are those who have reached the age of 18. Until the age of 16, parents apply for a child. However, from the age of 16, a child can independently apply for Chinese citizenship.

You should know that when immigrating and obtaining citizenship by persons under the age of majority, the application for them must be submitted by both parents. The reason for the absence of one of them must be objective.

So, if the spouses are divorced, it is necessary to make a notarized and translated into Chinese power of attorney for the right of the child to obtain citizenship. In the event of the death of the second parent, either declared incompetent, or deprived of parental rights, or in prison, this must also be documented.

The constitutional and legal status of a person and a citizen in the PRC determines in more detail the criteria for obtaining Chinese citizenship.

Is it possible to have dual citizenship in China?

China does not recognize dual citizenship. Thus, Article 8 of the “Law of the People's Republic of China on Citizenship” states that a person who applies for citizenship acquires it after the application is granted; a person whose request for citizenship has been granted does not retain the citizenship of another country.

However, the constitutional rights, freedoms and responsibilities of citizens in the PRC require some exceptions. For example, theoretically, foreigners who have received Chinese citizenship for any special merit can retain their previous citizenship. This requires their personal request and a corresponding government decision.

Registration of renunciation of native citizenship

Permanent residence in another country does not terminate a migrant’s existing citizenship. But if you want to obtain permanent residence in China, you will have to formally renounce your native citizenship. To do this, you need to make sure that there are no circumstances in your biography that preclude leaving the status of a citizen.

The procedure for renouncing citizenship in many countries is permissive in nature, i.e. For a number of reasons, your application may be denied.

Despite the fact that in Russia it is allowed to have a second citizenship, this legal norm conflicts with the legislation of countries that do not recognize this right. China is one of these states.

Therefore, if any person living in the Russian Federation is interested in how to obtain Chinese citizenship, he must clearly understand that this will lead to the fact that he will have to give up his Russian passport and all the benefits it provides.

Preparatory stage for obtaining Chinese citizenship for foreigners

If you are serious about achieving Chinese citizenship, you first need to decide how exactly you can achieve your goal. But in any case, the first step to Chinese citizenship is to create a kind of foundation for life in the Middle Kingdom. This can include employment, study, marriage, and, of course, long-term residence in China

In addition, keep in mind that the procedure for obtaining citizenship sometimes drags on for more than one year, and it is important that during this time you do not have problems with the law. The Chinese are very law-abiding, and they expect the same from foreigners.

Take a special responsibility in creating an impeccable reputation and consolidating it, including at work. When obtaining citizenship, reviews from employers about you will be useful. Remember: the Chinese highly value calm, hard-working people who can be relied upon, so these are the qualities that should be demonstrated first when making connections in Chinese society. Remember that your work achievements and the opinion of society can play a decisive role in granting or refusing.

Features of Chinese migration legislation

In October 1980, the People's Republic of China adopted the Law on Citizenship, which, with minor changes, is still in force. And although the economic and socio-political life of China has undergone radical changes over the past thirty years, this has had little effect on the rules for the naturalization of foreigners.

Expert opinion

Novikov Andrey Borisovich

Legal consultant with 7 years of experience. Specialization: criminal law. Recognized legal expert.

As before, the migration legislation of the PRC very meticulously considers applications from foreign applicants for citizenship. The opportunity to obtain a Chinese passport is provided only if certain conditions are met.

These include:

  • long-term permanent residence in China (more than 4-5 years);
  • presence of a spouse (parents, children) who are citizens of the PRC;
  • the fact of birth in China in a family of persons without citizenship of any country;
  • the presence of large investments in the Chinese economy;
  • special services to China.

Pros and cons of Chinese citizenship

Now that the market reforms launched by Deng Xiaoping in the mid-1980s have yielded tangible results, the idea that most of the country's population lives in poverty is no longer true. A Chinese passport provides considerable advantages, including for foreigners.

Currently, the average salary in China is 850 US dollars. Considering that the income of foreigners working in Beijing or Shanghai is almost always higher than the national average, moving to China for permanent residence makes some sense.

Moreover, this applies not only to highly qualified IT specialists, but also to citizens who are professional translators, engineers, teachers or artists.

When answering the question of how people live in China, it is always necessary to take into account the economic and geographical characteristics of the various regions of this country. The PRC has developed provinces in the south and east, where the standard of living is significantly higher than the statistical average.

Regions in the west and north-west of the country are less successful. This is reflected, among other things, at the level of salaries.

In addition, unlike Russia, in China the minimum wage is not set for the whole country, but separately for each province.

Purchasing methods

One of the easiest options for obtaining Chinese citizenship is birthright.

The following reasons are also relevant:

  • investments in the Chinese economy for a large amount;
  • employment in a company registered in China as a senior manager with at least four years of experience;
  • existing special services to the country;
  • marriage with a Chinese or foreigner with permanent residence rights;
  • presence of close Chinese relatives;
  • relatives at retirement age who, due to disability, are dependent on a Chinese citizen, a foreigner with a residence permit living in the country for at least 5 years;
  • children under the age of majority whose parents are citizens of the People's Republic of China or foreigners with a residence permit.

Individuals who have made a significant contribution to the development and prosperity of the country, famous scientists, and athletes also have the right to become a citizen of the PRC.

Peculiarities of obtaining a business visa to China for Russians - how to start your own business in the Celestial Empire?

A child whose at least one parent has a Chinese passport receives Chinese citizenship automatically, regardless of the country in which he was born.

An exception is the assignment of citizenship of another country to a newborn. In this case, he will automatically lose the opportunity to become a Chinese citizen by origin. Children born in China to stateless parents (stateless) receive Chinese citizenship.

Education at universities

The likelihood of obtaining a Chinese passport increases significantly after a foreigner graduates from a local university. Since this indicates knowledge of the national language, culture and traditions of China.

Employment

Foreigners who have been legally living and working in the country for a long time and who know Chinese at a sufficient level have the opportunity to become citizens of the PRC. Qualified employees, highly specialized specialists, professionals in complex or rare professions are valued here.

Family reunification

The Chinese strongly respect family values, so if you have relatives in China, this may be the basis for obtaining a passport. We are talking about close relatives: mother, father (including adopted ones), grandfather, grandmother on any line, as well as children (including adopted ones).

Restoration of Chinese citizenship

According to existing laws, foreigners who previously held a Chinese passport can restore citizenship in the following cases:

  • if their relatives remain in China;
  • they are permanently in the country.

How can a Russian apply for a visa to China on his own - how thorny is the path to the “Celestial Empire”?

Naturalization

The legal procedure for obtaining citizenship based on the voluntary desire of a resident. According to the bill, in order to apply naturalization, the following requirements must be met:

  • residence in China for at least 5 years;
  • availability of housing and work;
  • knowledge of language, culture and traditions;
  • integration into society.

The applicant must have lived in the PRC for at least five years, be an adult (over 20), and independently support themselves and family members. However, fulfilling all the requirements does not provide a guarantee of obtaining citizenship. The Chinese carefully consider candidates and at the slightest opportunity to reject a request, they will definitely do so.

Investment

A businessman who has made a contribution to the country’s economy, if the amount is significant, has a good chance of obtaining citizenship. In this case, the size of the investment must be really large, at least 2 million US dollars.

Intellectual property also has value. Applications from specialists who contribute their scientific and technical developments to the development of the PRC economy are considered first.

Other conditions for receiving

One of the options for obtaining a Chinese passport is marriage. This does not provide automatic citizenship, but it greatly simplifies the registration procedure.

What are the grounds

There are several ways to obtain Chinese citizenship for a Russian citizen. It will be easiest for those who have any roots or family ties in this country. Problems will not arise for entrepreneurs who have invested their capital in the development of the local economy (from 500 thousand to 2 million dollars, depending on the province).

How can those who do not have close relatives or large investments there move to live in China? Here the possibilities for naturalization become noticeably more complicated. If they have a sought-after professional qualification, this citizen will have to go through the entire procedure, starting with obtaining a work visa and then a residence permit. Only after 5-6 years, in the absence of any claims from the law enforcement and tax authorities of the PRC, a foreigner can apply for a Chinese passport. If the migrant has already learned the local language and has a permanent job, the chances of getting a positive decision on this issue will be high. True, you will have to give up your Russian passport.

Right by birth and descent

Having Chinese roots is a good reason to approve an application for a Chinese passport. In accordance with Art. 4 of the Law “On Citizenship”, if a person’s place of birth was China, and one or both of his parents were Chinese, then Chinese citizenship is granted under a simplified procedure.

If a child was born in China and his parents do not have citizenship, then under Art. 6 of the Law, such a person is assigned Chinese citizenship.

Can a child born in China in a family where both parents are Russian citizens subsequently apply for a Chinese passport? If you follow the provisions of the legislation of the Russian Federation, such a child is automatically assigned Russian citizenship. According to Chinese law, such a case does not provide any grounds for issuing a Chinese passport.

At the same time, the fact of birth in China can be taken into account when considering an application for citizenship. But do not forget that for a positive resolution of the issue, the applicant must already have a residence permit in the PRC and have been permanently residing in this country for several years.

Family reunification

If a child has one or both parents who are Chinese citizens, then he does not need to worry about obtaining a Chinese passport. According to the Nationality Law, he will be automatically granted Chinese citizenship. But what about other close relatives?

Under Chinese immigration law, a foreigner can obtain a residence permit based on family reunification. Its members are considered not only parents and children, but also other relatives of the first and second line of inheritance: grandchildren, grandparents, siblings.

Subsequently, the status of a residence permit holder will make it possible to obtain a passport.

Through marriage

The easiest and most effective way to become a citizen of the People's Republic of China is to find a Chinese husband or wife. This option of naturalization, however, has one nuance: local authorities recognize marriage with a citizen of the People's Republic of China as a legal basis for changing citizenship only after 5 years of official family relations.

This measure is intended to prevent cases of fictitious marriages between Chinese and foreigners.

Investing in the country's economy

The Chinese government is doing its best to stimulate the creation of new jobs. Foreign investors who invest heavily in the opening and development of private enterprises are even prepared to be granted the status of Chinese citizen. Of course, the issuance of passports according to this scheme does not occur automatically, but only if certain conditions are met:

  • the amount of investment should be from 500 thousand to 2 million dollars (the amount depends on the region of the country);
  • the enterprise must operate successfully and pay taxes for at least 3 years;
  • The number of jobs created is taken into account.

Most often, the issuance of a passport is preceded by the provision of a residence permit. If an enterprise really works successfully for the benefit of the PRC, its owner or hired manager has every chance of obtaining citizenship.

Naturalization

The vast majority of foreigners planning to move to China for permanent residence come to this country with only a work or study visa. Only after several months or even years can they count on being granted a residence permit in the PRC.

Of course, if the applicant has any of the benefits described above, everything speeds up noticeably. But in the absence of close Chinese relatives or one or two million dollars to open a business, a foreigner can count on a Chinese passport only on a general basis.

The length of stay on a residence permit or a work (study) visa plays a positive role for naturalization. The longer a person has lived in China, the higher the chances that an application for a Chinese passport will be decided in his favor.

Typically, this requires living in the country for at least 5 years, without having any claims from law enforcement and tax authorities during this time.

Chinese Citizenship: Pros and Cons

This point cannot be ignored, given how radically opposing opinions exist on this matter. Therefore, before making a final decision, appreciate the advantages and disadvantages of the status of “citizen of the People's Republic of China”.

Legislation positions China as a multinational country

So, the pros:

  • demand for qualified personnel;
  • high standard of living, affordable prices;
  • visa-free travel throughout the country;
  • access to government positions;
  • the right to participate in the electoral process;
  • doing business on more favorable terms.

However, along with these important advantages, Chinese citizenship also has significant disadvantages. First of all, these are the difficulties that will arise when obtaining visas to other countries.

The list of states with which the Chinese authorities have established a visa-free regime is much shorter than the similar list in Russia. It is especially difficult for Chinese citizens to travel legally to Western countries. Thus, the Chinese have much fewer opportunities to travel abroad than the Russians. At the same time, the Chinese authorities may not even voice the reasons for refusing a visa: no, that’s all. But even if yes, you will have to try very hard first.

Everyone has the right to apply for Chinese citizenship, regardless of ethnicity.

To travel outside the country on a tourist visa, a Chinese citizen will also have to pay a deposit of 50 thousand yuan (more than 7.5 thousand dollars). In addition, many states are very reluctant to allow the Chinese into their territory. They say, if you let one in, he will quickly settle down and begin to “pull up” his many relatives.
