Kazakhstan is a fairly young republic and a large number of Russians live on its territory. The division that occurred after the collapse of the USSR now obliges permanent residents of this republic to obtain Kazakh citizenship. Citizens of Uzbekistan can cross the Russian border only if they have a foreign passport. Who can apply?

At the end of 1991, the Kazakh Government adopted a law on citizenship of the Republic of Kazakhstan, which covers all options for obtaining resident status legally:

  1. By right of birth, citizenship is automatically assigned if the parents do not want to make their child a citizen of another state.
  2. Naturalization.
  3. If a person marries a representative of Kazakhstan.
  4. By right of permanent residence. This category applies to those who have been permanently residing in the republic since the end of 1991.
  5. If a foreigner lives in the territory of the republic for more than five years.

The legislative framework

The acquisition of citizenship of the Republic of Kazakhstan by a foreigner is regulated by the “Law on Citizenship of the Republic of Kazakhstan”. It was approved by the Supreme Council of the Republic at the end of 1991. Over the past period, several changes have been made to it. The latest edition of the Law dates back to January 2021.

Prior to this, changes were made in 2009, 2021, and 2021. Recent innovations in citizenship legislation were caused by the fact that it did not clearly define the possibility of having dual or second citizenship. Ways to obtain citizenship

Admission to citizenship of the Republic of Kazakhstan

In accordance with Article 10 of the Law of the Republic of Kazakhstan “On Citizenship of the Republic of Kazakhstan”, citizenship is acquired:

  • by birth;
  • if the citizen was permanently residing in Kazakhstan on March 1, 1992 and did not submit a statement of unwillingness to be a citizen of the Republic of Kazakhstan before March 1, 1995;
  • as a result of admission to citizenship of the Republic of Kazakhstan.

If you are a citizen of another state or a stateless person, then by submitting an application, you can be granted citizenship of the Republic of Kazakhstan in accordance with the norms of the Law of the Republic of Kazakhstan “On Citizenship of the Republic of Kazakhstan”, the Regulations on the Commission on Citizenship Issues under the President of the Republic of Kazakhstan, Instructions for consideration by the internal affairs bodies of the Republic of Kazakhstan of issues related to citizenship and Instructions for the preparation of documents on issues of citizenship of the Republic of Kazakhstan by foreign institutions of the Republic of Kazakhstan.

According to Article 16 of the Law “On Citizenship” the following may be granted citizenship of the Republic of Kazakhstan:

  • persons permanently residing in the territory of the Republic of Kazakhstan for at least five years (at the time of filing an application for citizenship, the five-year period of residence in the Republic of Kazakhstan must be continuous);
  • married to a citizen of the Republic of Kazakhstan (residing for at least 3 years);
  • having one of their close relatives who lives on the territory of Kazakhstan and is a citizen of the Republic of Kazakhstan. Close relatives include: father, mother, siblings, husband, wife, children, grandmother, grandfather, regardless of the length of their residence in Kazakhstan.

According to the last two grounds, admission to citizenship is carried out regardless of the period of residence on the territory of the republic.

There is a regular procedure for admission to citizenship and a simplified procedure.

Simplified procedure for admission to citizenship of the Republic of Kazakhstan

The simplified (registration) procedure for admission to citizenship is carried out in accordance with international agreements concluded by the Republic of Kazakhstan. Currently, the simplified procedure applies to the following persons:

  • citizens of the Russian Federation;
  • citizens of the Republic of Belarus;
  • citizens of the Republic of Kyrgyzstan;
  • citizens of Ukraine;
  • foreign women married to a citizen of Kazakhstan;
  • meeting the requirements of the List of professions and requirements for persons in respect of whom a simplified procedure for admission to citizenship of the Republic of Kazakhstan is established at the request of the relevant government body.

The simplified procedure operates in accordance with the Agreement between the Republic of Belarus, the Republic of Kazakhstan, the Kyrgyz Republic and the Russian Federation “On the simplified procedure for acquiring citizenship” dated 02/26/1999, the Agreement between the Republic of Kazakhstan and Ukraine “On the simplified procedure for the acquisition and termination of citizenship by citizens of the Republic of Kazakhstan, permanently residing in Ukraine, and citizens of Ukraine permanently residing in the Republic of Kazakhstan, and preventing cases of statelessness and dual citizenship” of May 19, 2000 and the Convention on the Nationality of Married Women of January 29, 1957.

Each of the above countries has undertaken to provide its citizens arriving for permanent residence in the territory of another country with a simplified (registration) procedure for acquiring citizenship if one of the following conditions is met:

  • if the applicant was a citizen of the Byelorussian SSR, Kazakh SSR, Kyrgyz SSR or RSFSR and at the same time a citizen of the former USSR, was born or lived in the territory of the state of acquired citizenship before December 21, 1991 (the Republic of Belarus, the Kyrgyz Republic and the Russian Federation);
  • if the applicant permanently legally resides in the territory of the state of acquired citizenship, regardless of the period of residence (Ukraine);
  • if the applicant has close relatives of citizens of the country: spouse, parents (adoptive parents), children (including adopted children), sisters, brothers, grandparents, permanent residents and citizens of the state of acquired citizenship.

The simplified procedure applies to citizens of these states permanently residing in the territory of another state, regardless of the period of residence in the territory of the state of acquired citizenship.

List of documents for citizens of Russia, Belarus and Kyrgyzstan

Paragraphs 34, 35 of the Instructions for consideration by the internal affairs bodies of the Republic of Kazakhstan of issues related to the citizenship of the Republic of Kazakhstan define a list of necessary documents for citizens of the Russian Federation, the Republic of Belarus, and the Kyrgyz Republic for acquiring citizenship of the Republic of Kazakhstan in a simplified manner and terminating the citizenship of another state.

To do this, citizens of these states submit an application addressed to the head of the regional Department of Internal Affairs and at the same time to the official of the state of destination who makes decisions on citizenship issues, with a notarized written renunciation of foreign citizenship, and submit them to the migration police units of city (district) internal affairs bodies at the place of permanent residence.

The following documents must be attached to the application:

  • application form of the approved form;
  • a notarized copy of the application for renunciation of previous citizenship;
  • four photographs measuring 3.5 x 4.5 cm;
  • obligation to comply with the conditions provided for in Article 1 of the Law “On Citizenship”, which is drawn up in the prescribed form (on compliance with the Constitution and laws of the Republic of Kazakhstan);
  • a copy of a passport or other identification document confirming citizenship of a country party to the agreement;
  • a notarized copy of the birth and marriage certificate;
  • document confirming payment of state duty in the amount of 100% of the monthly calculation index (MCI) (subparagraph 5) of Article 538 of the Tax Code of the Republic of Kazakhstan);
  • if necessary, additionally a document confirming the presence of one of the conditions necessary for accepting citizenship in a simplified manner. Such a document can serve as a copy of a birth certificate, passport, other document confirming birth on the territory of the Republic of Kazakhstan, a copy of a passport page with a mark on registration at the place of residence before December 21, 1991 in the territory of the countries participating in the Agreement or a certificate from the competent authority about this , a copy of a marriage certificate, birth certificate or other document confirming family ties with a citizen of the Republic of Kazakhstan.
List of documents for citizens of Ukraine

According to paragraph 36 of the Instructions for consideration by the internal affairs bodies of the Republic of Kazakhstan of issues related to the citizenship of the Republic of Kazakhstan, citizens of Ukraine, in order to acquire citizenship of the Republic of Kazakhstan in a simplified manner and terminate the citizenship of their state, apply to the head of the regional Department of Internal Affairs and at the same time to the President of Ukraine, with a notarized written renunciation of Ukrainian citizenship, and submit them to the migration police units of city (district) internal affairs bodies at the place of permanent residence.

The following documents must be attached to the application:

  • a notarized copy of the application for renunciation of previous citizenship;
  • application form of the approved form;
  • three photographs;
  • a document confirming that the applicant, or at least one of his parents (adoptive parents), grandparents were born or permanently legally resided in the territory of the Republic of Kazakhstan or if the applicant has at least one of the permanently legally residing in the territory of the Republic of Kazakhstan and close relatives who are its citizens: spouse, one of the parents (adoptive parents), child (including adopted child), sister, brother, grandfather or grandmother, grandson (granddaughter);
  • a document confirming permanent legal residence on the territory of the Republic of Kazakhstan;
  • a document confirming the fulfillment of military duty or exemption from military duty (for persons of military age).

Citizens of Ukraine are exempt from paying state fees when applying for citizenship in a simplified manner.

List of documents for a foreign citizen married to a Kazakh citizen

In accordance with paragraph 36-1 of the Instructions for consideration by the internal affairs bodies of the Republic of Kazakhstan of issues related to the citizenship of the Republic of Kazakhstan and the Convention on the Citizenship of Married Women, a foreigner who permanently resides in the territory of the Republic of Kazakhstan legally and is married to a citizen of Kazakhstan submits an application for admission to citizenship of the Republic of Kazakhstan in a simplified manner addressed to the head of the regional Department of Internal Affairs and at the same time to the official of his state who makes decisions on citizenship issues, with a notarized written renunciation of foreign citizenship, and submits them to the migration police unit of the internal affairs bodies at the place of permanent residence .

The following documents must be attached to the application:

  • a notarized copy of the application for renunciation of previous citizenship;
  • application form of the approved form;
  • four photographs measuring 3.5 x 4.5 cm;
  • obligation to comply with the conditions provided for in Article 1 of the Law of the Republic of Kazakhstan “On Citizenship of the Republic of Kazakhstan” (on compliance with the Constitution and laws of the Republic of Kazakhstan);
  • a copy of a passport confirming citizenship of a foreign state;
  • a copy of the marriage certificate;
  • a copy of the identity card of the spouse - a citizen of the Republic of Kazakhstan;
  • document confirming payment of state duty in the amount of 100% of the monthly calculation index (MCI) (subparagraph 5 of Article 538 of the Tax Code of the Republic of Kazakhstan).
Result of consideration of the application

Based on the results of consideration of applications, a reasoned conclusion is issued, which is approved by the head of the Department of Internal Affairs or his deputy. The applicant is notified of the decision made by an employee of the migration police unit by telephone or in person, within 7 working days from the date of conclusion of the DIA, and he is issued a certificate certified by a seal, which is the basis for issuing, in the prescribed manner, an identity card and a passport of a citizen of the Republic of Kazakhstan.

Persons admitted to citizenship in a simplified manner, upon receipt of the certificate, hand over national passports of the country of previous citizenship, which, together with the notarized original applications for renunciation of previous citizenship and messages about the acquisition of citizenship of the Republic of Kazakhstan, are sent to the Department of Consular Service of the Ministry of Foreign Affairs of the Republic of Kazakhstan for further sending to the competent authorities of the relevant states.

Time limit for reviewing materials under a simplified procedure

According to paragraph 42 of the above Instructions, the period for consideration of materials on the acquisition of citizenship should not exceed 3 months from the date of filing the application.

Generally established procedure for admission to citizenship of the Republic of Kazakhstan

List of documents when submitting an application in the generally established order:

Foreigners who do not have the right to be granted citizenship in a simplified manner and who wish to acquire citizenship of the Republic of Kazakhstan must submit an application to the territorial divisions of the migration police at their place of permanent residence. The application-petition is submitted to the President of the Republic of Kazakhstan. The application must indicate the reasons for accepting citizenship.

According to paragraph 15 of the Instructions for consideration by the internal affairs bodies of the Republic of Kazakhstan of issues related to the citizenship of the Republic of Kazakhstan, the following documents are attached to the application:

  • questionnaire - an application in the prescribed form;
  • four photographs measuring 3.5 x 4.5 cm;
  • obligation to comply with the conditions provided for in Article 1 of the Law of the Republic of Kazakhstan “On Citizenship of the Republic of Kazakhstan” (on compliance with the Constitution and laws of the Republic of Kazakhstan);
  • certificate of presence or absence of criminal record;
  • a copy of an identity document, a child’s birth certificate;
  • a certificate of absence or termination of citizenship of another state, issued by the competent authority of the relevant state;
  • an application to an official of the state of arrival who makes a decision on issues of citizenship, with a notarized written renunciation of foreign citizenship (this document, instead of that specified in the previous paragraph, is submitted by the persons specified in paragraph two of subparagraph 1) of paragraph 12 of the Instructions, namely minors, incompetent and persons who have special merits to the Republic of Kazakhstan, or have professions and meet the requirements according to the list established by the President of the Republic of Kazakhstan, and members of their families, as well as persons who left the territory of Kazakhstan, and their descendants, if they returned for permanent residence in the Republic of Kazakhstan as to the historical homeland);
  • a document confirming payment of state duty in the amount of 100% of the monthly calculation index (MCI) (subparagraph 5) of Article 538 of the Tax Code of the Republic of Kazakhstan) or exemption from its payment.
  • petition from the relevant government body (for persons meeting the requirements of the list of professions and requirements for persons for whom a simplified procedure for admission to citizenship is established);
  • Oralman's certificate and a notarized application to the official of the state of arrival, who makes decisions on citizenship issues, about renunciation of previous citizenship (for persons who returned for permanent residence to the Republic of Kazakhstan as their historical homeland);
  • a notarized copy of the marriage certificate (for persons who, at the time of filing the application, are married to a citizen of the Republic of Kazakhstan);
  • documents certifying the degree of relationship with citizens of the Republic of Kazakhstan (birth certificates, marriage certificates, etc.) (for citizens of the former union republics who arrived for the purpose of permanent residence in the Republic of Kazakhstan and have one of their close relatives - citizens of the Republic of Kazakhstan).
Procedure for consideration of the application

District (city) internal affairs bodies transfer materials on admission to citizenship to the Departments of Internal Affairs of the regions and cities of Almaty and Astana, which check them, make an opinion on them and transfer them to the Ministry of Internal Affairs. The Ministry of Internal Affairs sends materials with its conclusion to the State Legal Department of the Administration of the President of the Republic of Kazakhstan.

Filing applications from minors and incapacitated persons

For children under 18 years of age, as well as citizens declared incompetent, a notarized application for citizenship is submitted by their legal representatives (parents, adoptive parents, guardians). The application is accompanied by a copy of the child’s birth certificate, a document confirming incapacity and a document confirming the powers of the legal representative of the incapacitated person. For a child aged 14 to 18 years, a separate consent is required, signed by him and certified by a notary (clause 9 of the Instructions for consideration by the internal affairs bodies of the Republic of Kazakhstan of issues related to the citizenship of the Republic of Kazakhstan).

Deadline for reviewing documents in accordance with the generally established procedure

In accordance with paragraph 10 of the Instructions for consideration by the internal affairs bodies of the Republic of Kazakhstan of issues related to the citizenship of the Republic of Kazakhstan, the period for consideration of applications in local internal affairs and national security bodies, the Ministry of Internal Affairs of the Republic of Kazakhstan and other government bodies of the Republic of Kazakhstan should not exceed one month per month. each of these organs, and in total - six months.

Result of citizenship

The applicant is notified of the decision made by an employee of the migration police unit by telephone or in person, within 7 working days from the date of signing the Decree of the President of the Republic of Kazakhstan.

Foreigners and stateless persons who have been granted citizenship of the Republic of Kazakhstan are issued a certificate, which is the basis for issuing them, in the prescribed manner, an identity card and a passport of a citizen of the Republic of Kazakhstan.

Grounds for refusal to grant citizenship of the Republic of Kazakhstan

The list of such grounds is given in Article 17 of the Law “On Citizenship”. An application for admission to Kazakh citizenship is rejected if the person applying for it:

  • committed a crime against humanity, provided for by international law, consciously opposes the sovereignty and independence of the Republic of Kazakhstan;
  • calls for violation of the unity and integrity of the territory of the Republic of Kazakhstan;
  • carries out illegal activities that harm state security and public health;
  • incites interstate, interethnic and religious hatred, opposes the functioning of the state language of the Republic of Kazakhstan;
  • convicted of terrorist activities;
  • recognized by the court as a particularly dangerous repeat offender;
  • is a citizen of other states. This provision does not apply to citizens of the former union republics who arrived for the purpose of permanent residence in the Republic of Kazakhstan, who have one of their close relatives - citizens of the Republic of Kazakhstan, if they applied to the internal affairs bodies with a written request to renounce foreign citizenship.

Moment of acquisition of citizenship

To determine the moment from which a person is a citizen of the Republic of Kazakhstan, it is necessary to use Article 37 of the Law “On Citizenship”, according to which citizenship of the Republic of Kazakhstan is acquired on the day:

  • publication of the Decree of the President of the Republic of Kazakhstan on admission to citizenship;
  • birth or adoption of minors;
  • publication of the Decree of the President of the Republic of Kazakhstan on the admission of parents of minors to citizenship of the Republic of Kazakhstan;
  • registration of citizenship in the manner prescribed by interstate treaties (for example, the day of approval of the conclusion by the internal affairs body on admission to citizenship in a simplified manner, in relation to citizens of Ukraine - the moment of termination of Ukrainian citizenship).

Duration of residence on the territory of Kazakhstan required to obtain citizenship

Article 16 of the Law “On Citizenship” (subparagraph 1) provides for the requirements for the period of permanent residence in the Republic of Kazakhstan on legal grounds for obtaining citizenship:

  • at least 3 years - for those married to Kazakh citizens;
  • at least 5 years for everyone else.

Regardless of the period of residence, in accordance with subparagraph 2) of Article 16 of the Law “On Citizenship”, citizens of the former union republics of the USSR who arrived for the purpose of permanent residence in the Republic of Kazakhstan and who have one of their close relatives - citizens of the Republic of Kazakhstan, can be granted citizenship, namely:

  • child (including adopted child);
  • spouse;
  • one of the parents (adoptive parents);
  • sister;
  • brother;
  • grandfather;
  • grandmother.
What is included in the period of residence in Kazakhstan?

In accordance with Article 37 of the Law “On Citizenship”, the following period of residence on the territory of the republic is counted towards the above period of residence:

  • time of service in the army, if the person previously lived on the territory of the republic and the break between the day of discharge from the army and the day of arrival in the Republic of Kazakhstan for permanent residence does not exceed 3 months;
  • time of study outside the republic, if the break between graduation or expulsion from an educational institution and the day of arrival in the Republic of Kazakhstan does not exceed 3 months;
  • the time of departure on a business trip outside the republic, if the break between the end of the business trip and the day of arrival in the Republic of Kazakhstan does not exceed 3 months.

The calculation of the specified 3-month period is suspended in the event of illness, natural disaster or other valid reasons.

What does not count towards the period of residence in Kazakhstan?

In accordance with Article 37 of the Law “On Citizenship”, the period of residence on the territory of the Republic of Kazakhstan does not include:

  • the time of serving criminal penalties imposed by the judicial authorities of other states;
  • length of stay on the territory of the Republic of Kazakhstan on a business trip, for treatment and other cases of temporary residence;
  • the period preceding the cancellation of a person’s citizenship of the Republic of Kazakhstan (for example, upon loss of citizenship).
Does temporary travel outside of Kazakhstan count towards the period of residence?

In accordance with Article 10 of the Law of the Republic of Kazakhstan “On Migration of the Population”, immigrants who have received a residence permit enjoy all rights and freedoms in the Republic of Kazakhstan, and also bear responsibilities on an equal basis with citizens of the Republic of Kazakhstan, unless otherwise provided by legislative acts of the Republic of Kazakhstan. There are no special conditions for temporary departure for permanently residing foreigners. Consequently, such foreigners, having a residence permit, can travel outside the Republic of Kazakhstan on a general basis and freely return to the Republic, provided that the departure is temporary. A minor (regardless of the program) will need a birth certificate and an application from his parents. If it comes from only one of them, then the second must provide his notarized consent.
